Prior to beginning work on this discussion forum,

Review:

Based on your readings throughout the course examining capital punishment (the death penalty), create a two to three-minute Screencast-O-Matic video detailing whether the death penalty should be continued or abolished in the United States. The “curveball” for this discussion is that you must argue for the opposite side of the issue than you chose in the discussion in Week One. For example, if you stated that you were in favor of capital punishment in Week One, you must create a video to argue against the continuation of the death penalty. If you against the death penalty in Week One’s discussion, you must now create the best arguments you can for its continuation as a viable sentencing option in the United States.

week 6 discussion 2

based on your research, course readings, discussions, and the Supreme Court Philosophies and Rulings paper for this course, provide an analysis of the following Course Outcomes you learned throughout the course.

  1. Analyze the view of the U.S. Supreme Court majority regarding police behavior in the present environment.
  2. Evaluate the pre-trial, trial, and appellate processes in modern criminal justice.

Based on what you have learned throughout the course, what could be done to improve current Supreme Court practices? It is recommended that your post contain approximately 300 words.

Guided Response: You are encouraged to “think outside the box” in this discussion. Share how you have grown in understanding the Supreme Court and how constitutional rights are protected (or not) in the United States. Present how you anticipate using this expanded knowledge of the criminal justice system in your career and personal life. Review your colleagues’ posts, and substantively respond to the Learning Objectives postings that you did not address in your primary posting. So, if your last name begins with the letters A through M, you will respond to fellow students’ postings addressing Learning Outcomes 4 and 5, and vice versa. Make sure that you respond utilizing scholarly sources to at least two of your peers. Continue to monitor the discussion forum until 5:00 p.m. (Mountain Time) on Day 7 of the week and respond to anyone who replies to your initial post.

Supreme Court Philosophies and Rulings

Garnering all of the information about constitutional rights and the justice process you have received from this course and your understanding of the “personalities” of the U.S. Supreme Court, prepare a paper in which you detail the history of the Supreme Court from 1953 to the present day as it relates to one of the specific issues listed below.

Your paper will focus on the court process, judicial process, and constitutional issues for one of the following issues:

  • The right against self-incrimination and the right to remain silent (U.S. Const. amend. V)
  • The right to privacy for computer, internet, and cell phone property and communications (U.S. Const. amend. IV)
  • Search and seizure laws as applied to computer, internet, and cell phone property and communications (U.S. Const. amend. IV)
  • Right to counsel (U.S. Const. amend. VI)
  • Capital punishment and cruel and unusual punishment (U.S. Const. amend. VIII)
  • Right to trial in criminal proceedings (U.S. Const. amend. VI)
  • National security considerations

In your paper,

  • Evaluate the terms of the Warren Court (1953–1969), the Burger Court (1969–1986), the Rehnquist Court (1986–2005), and the current Roberts Court (2005–present) to your chosen issue.
  • Examine the political philosophies of each court.
  • Indicate significant changes in the law concerning your chosen issue witnessed through each court’s era.
  • Examine the current makeup of the U.S. Supreme Court and modern trends in constitutional law and criminal procedure.
  • Based on current trends, discuss whether you believe the criminal justice process will fundamentally change or remain the same in the foreseeable future for your chosen issue.

Examine the Current United States Supreme Court’s Majority View Regarding Police Behavior

Prior to beginning this journal, read:

Your journal assignment this week will examine the current U.S. Supreme Court’s views on police behaviors. The Supreme Court cannot make policies like a police agency or write laws to regulate police behaviors. The Court is limited to using Opinions in cases brought before it to either sanction or deny police behaviors that come in conflict with the Constitution. Drawing from the website, Supreme Court Sides with Police Officers in Two Qualified Immunity Cases, and the article, “Qualified Immunity: Both Sides of the Debate,” create a two to three-page reflection about the Supreme Court’s current views toward police actions. Predict how this Court will handle policing issues over the next decade. You may also draw from the cases in the recommended resources section this week. Additionally,

  • The Journal must be written grammatically correct and be two to three double-spaced pages (500 to 750 words).
  • Use at least one scholarly source besides the course text and materials provided in the classroom.
