The Case of the Fired Employee

Sally Birch, a vice president of the Acme Trailer Company, enjoyed a wonderful reputation as a capable and trustful financial officer. She, her husband, and their two children lived in a beautiful suburb in a large, comfortable home. The president of a competitor firm, International Trailers Ltd., wanted to hire Birch for a similar position and offered her an increased salary and many employee benefits. The President of International had an extensive phone conversation with her about this offer. Birch accepted the offer, sold her home, moved to the city in which her new employer was located, and purchased a home there. She did not have a written contract, but she was told she had a great future with the company and was given a salary of $150,000 per year with a promise of a promotion every 6 months for the first two years. A bonus could be paid to her after 18 months on the job.

Four months after Birch joined the company, she was fired because of a downturn in the trailer production business, requiring a scaling back of expenses at International. She sued International for a breach of contract.

The Trial

During the trial, Sally testified about the reputation she had earned while at Acme Trailer and the wonderful life that she and her family had enjoyed. She told of the difficulties involved in moving, the expense of buying a new home, and the uprooting of her family. She described the difficulties involving in selling her new home and looking for a new position.

An officer of International testified about the recession in the trailer industry and how economic conditions were such that if International failed to cut expenses, it might be forced out of business.

The Arguments at Trial

Sally’s attorney argued that although she did not have a written contract, oral representations made to her implied that her job would last longer than a year; that she was going to earn a yearly salary indicated that her employment would, at a minimum, last at least two years. The attorney stressed the difficulties involved in the move and the expenses occurred by the Birch family, arguing that it would be unfair to terminate her employment except for cause relating to her activities. The argument was also made that the “employment at will” doctrine was an outmoded and unfair concept and should not be applied based on the facts in this case.

International’s attorney argued that the lack of a written contract and the existence in the state in which International was located of the “termination at will” doctrine gave International the right to terminate Birch’s employment at any time for any reason, particularly when economic conditions required cutting the expenses, including termination of the employment of executives with high salaries.

Questions for Discussion

  1. Based on the facts of this case, who do you think should prevail, Birch or International? Why?
  2. Are there other facts that would make it easier for the court to decide who should prevail?
  3. Do you feel that the employment at will doctrine should no longer apply? If so, who should make the change, the legislatures or the courts? Why?

chain of custody 1

This week you examined the process of locating and documenting evidence at a crime scene. Pieces of evidence will pass through many hands between the crime scene and the courtroom. Properly managing the evidence throughout the entire process is critical.

  • Describe what is meant by “chain of custody” and why it is important to an investigation.
  • Provide an example to show how improper custody can damage a case (hint: put yourself in the position of the defense attorney).
  • Improper custody can certainly impair or even destroy an investigation. Is this in the best interests of justice? Should valid physical evidence be excluded due to improper custody? Explain and justify your position.

Please address the following: What do you think about the concept “new black”? In relation to our course, how do you think this idea fits with the goals of black people in the African diaspora? Does the emergence of “new black” indicate that black people have achieved full citizenship? What historical changes, if any, permit the possibility of this concept? Can the “new black” apply to black people throughout the African diaspora, or just in the United States? Does race still matter in the 21st century?

You must clearly state your opinion and then make a fact-based case to back up your position.

launch of new product service or collaboration 2

1. We need a virtual collaboration, we choose brand( Audemars Piguet watch and mclaren automotive)

2.Just like (Hublot and Ferrari Open a New Chapter in Their Collaboration With the Classic Fusion Ferrari GT Watch).

take this example : https://www.prnewswire.com/news-releases/hublot-and-ferrari-open-a-new-chapter-in-their-collaboration-with-the-classic-fusion-ferrari-gt-watch-300817104.html

3. here is the requirements for the paper.

You must choose a brand and determine a new product, service, or a collaboration between two different brands, (i.e. Adidas and Kanye West “Yeezy”), that does not exist for the brand – meaning, the brand does not currently offer it to consumers. This is a mistake made by a few groups in the past. Be sure to thoroughly research the internet to ensure your brand does not currently offer this product, service, etc., otherwise your paper will not be accepted. If you are unsure, check with me.

Next, write an introduction/description of the brand itself that includes a brief history as well as a current SWOT analysis of the brand. You then need to introduce and briefly explain the rationale of your brand’s new product or service – specifically how will this new product benefit the brand? How will it satisfy a specific need or want for consumers? You do not have to elaborate too much because this is what the 4Ps section is for. You simply want to introduce the product and explain the rationale at the end of the intro. Here is an example of the rationale statement:

“Blue Apron will license its brand with Amazon/Whole Foods and sell meal kits and fully prepared “meals to go” at all U.S. based Whole Foods Markets. The rationale for this new service is to combat the loss of market share Blue Apron is experiencing in terms of its steadily decreasing online subscription base. The company sustained a 50% loss of online subscribers between January 2017 and January 2018 (source). The goal of the partnership is to position Blue Apron as a high quality “meals-to-go and meal kit brand” to consumers who seek healthy food choices.”

You then need to complete a thorough 4Ps analysis with specific categories: product, price, placement, promotion. The 4Ps analysis must directly relate to your new product, service, or collaboration idea.

You must use the following subheadings to organize your paper:

  • Introduction
  • SWOT Analysis
  • New Product or Service Rationale
  • 4 Ps Analysis with subtitles: Product, Pricing Model, Placement, and Promotion
  • Works Cited (in-paper citations and a list of citations in APA format at the end of your paper)

The word count of your paper should fall between 1000 to 1300 words of text (about four to five pages). Supporting cites, sources, etc., are required and need to appear WITHIN your document AND SEPARATELY at the end of the paper in a Works Cited Section. At least FOUR industry sources are required for this paper. Use APA style for referring to sources within your paper and in your separate cite/source list. Make sure your Works Cited page is well organized, easy to interpret and in-paper cites are BOLDED. I strongly recommend you number sources and reference the numbers within your paper. I check the validity of all sources as well as the citation pattern within your document. Make sure you carefully review the grading rubric for this assignment in order to address all deliverables.

immigration officer powerpoint slide

You are an immigration officer assigned to the anti-terrorist investigative squad. The squad’s mission is to maintain a list of known terrorists and terrorist organizations. Part of your duties is preparing intelligence reports on information supplied to you by your counterparts, immigration officers in Canada and Mexico, regarding illegal alien terrorists entering their countries and destined to attempt to enter the U.S. You have been given the task of comparing and contrasting the US extradition concepts relating to illegal alien terrorists in a report to your foreign counterparts and your supervisor.

Create a presentation of 5 to 7 slides in Microsoft PowerPoint, which includes the following:

Explain the different statute(s) and procedures that pertain to the US extradition laws relating only to illegal alien terrorists.

Analyze who should detain the terrorist(s)–Canada, Mexico, or the U.S. Why?

What are the extradition treaty issues that need to be resolved, and how can they be resolved?

Do terrorists held in exclusion proceedings have constitutional due process rights? Why or why not?

Would it be possible not to extradite an illegal alien terrorist to Canada or Mexico? How? What extradition concept or statute does this possibility refer to?

In your opinion, explain, with reasoning, one way to change the current US extradition policy to make the extradition of illegal alien terrorists less complex (faster and easier).

Support your responses with examples.

Cite any sources in APA format.
