Habeas   Corpus and the War on Terror

 Soon after the U.S. invasion of Afghanistan in 2001, the Bush administration developed a plan for holding and interrogating prisoners captured during the conflict. They were sent to a prison inside a U.S. naval base at Guantanamo Bay on land leased from the government of Cuba. Since 2002, over 700 men have been detained at “GITMO.” Most have been released without charges or turned over to other governments. In 2011, Congress specifically prohibited the expenditure of funds to transfer GITMO prisoners to detention facilities in the continental United States, making it virtually impossible to try them in civilian courts. As of April 2012, 169 remained in detention at GITMO (Sutton, 2012).   
 

An assumption made by the Bush administration in selecting this location was that it was beyond the jurisdiction of U.S. courts. The administration wanted to avoid any judicial oversight of how it handled detainees, characterized as “enemy combatants.” A possible legal challenge to indefinite detention with no formal charges or judicial proceedings might arise from the habeas corpus provision of the Constitution.
 

Article I, Section 9 of the Constitution states, “The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.” Under this provision, persons detained by the government are entitled to a judicial hearing to determine if there is any legal basis for their detention. Some legal commentators refer to the right of habeas corpus as the “great writ of liberty” because it is a prisoner’s ultimate recourse to an impartial judge to review the possibility that he is being held illegally by the executive (e.g., the police or the military). In nations that do not honor habeas corpus, people simply disappear into prisons without ever having their day in court.
 

Several controversial Supreme Court cases have come out of GITMO. One fundamental question that has been debated, but not clearly resolved, is to what extent the war on terror justifies the President’s indefinite detention of “enemy combatants” without the possibility of the minimal judicial review protected by habeas corpus? Another issue in the debate is to what extent Congress must clearly authorize the President to conduct extra-judicial detentions in order for them to be legal? In 2008, the Supreme Court’s decision in Boumediene v. Bush offered some answers to these questions. However, the deeply divided 5-4 Court and the likelihood of the protracted nature of the war on terror suggest that debate around these important questions will continue.

The purpose of this forum is for you to share and discuss with classmates your understanding of some of the academic literature about this subject in order to help you write the Final Paper in the course. Read it      carefully and try to understand the author’s main points that may be      relevant to your final essay. First, give the full APA citation for the      article. Then, summarize the relevant main points and explain the author’s      reasoning as you understand it. At the end of your summary, ask one      question about a specific point in the article that you do not understand      and would like some help with (refer to a page number).   In 50 to 75 words, state what you believe the thesis of      your Final Paper will be. State the thesis as clearly and fully as you      can. Draw upon what you have learned from all the required resources you      reviewed for this discussion. While you can change your mind about your      thesis when you actually write the Final Paper, use this discussion forum      as a serious opportunity to try out a thesis and receive feedback from      your peers.

Case Study Proposal

In this assignment, you will be creating a hypothetical proposal for a case study that will focus on one country, excluding North America, and one major health issue that is related to the environment. Case studies are usually used to organize a wide range of information about a case/topic and then analyze the contents by seeking patterns and themes in the data and by further analysis through cross comparison with other cases. The case study either adds to the larger scholarship or challenges it to move in a new direction. Again, this is a theoretical case study, so have some fun.  In this project, you will include the following:

Background of the health condition and country. What is the history of the health condition and the country chosen for this proposal?  How is this health condition related to the environment?

Goal(s)/Hypothesis of the study. What is your goal for this case study? What do you want to learn or what do you hope to theorize? How will this case study add to the knowledge Do you want to examine the link between health issue and the environment?

The research design/methodology (how information was collected). How will you conduct this case study? You might be including interviews, measurements, sampling, and so forth. Be sure to include all relevant details such as schedules, dates and times, locations, and personnel who performed the collection. You may want to summarize this information in the body of the report and include details in an appendix. You can include the following information:

Participants. (optional) How did you select participants or subjects for the study? What is each participant’s background and history?

The data that will be collected. Depending on what you are studying, this section could include videos, transcripts of interviews, collections of documents, descriptions of test results, recorded observations – all kinds of topics could go in this section.

Analysis of the data. This section is likely to include statistical summaries and patterns found in the data.

Significance/Conclusions. Were your questions answered? Did the study meet the goals? Was the hypothesis supported or refuted? What are the implications for the future?

When looking for information about a particular issue, how often do you try to resist biases toward your own point of view? This assignment asks you to engage in this aspect of critical thinking.

The assignment is divided into two (2) parts.
For Part I of the assignment (due Week 2), you read a book excerpt about critical thinking processes, reviewed the Procon.org Website in order to gather information, and engaged in prewriting to examine your thoughts.
* Remember that in the Week 2 Discussion, you examined the biases discussed in Chapter 2 of the webtext.

In Part II of the assignment (due Week 4), you will write a paper to synthesize your ideas.
Part II – Writing
Write at three to four (3-4) page paper in which you:
1. State your position on the topic you selected for Assignment 1.1.
2. Identify (3) three premises (reasons) from the Procon.org website that support your position    and explain why you selected these specific reasons.
3. Explain your answers to the “believing” questions about the three (3) premises opposing your position from the Procon.org website.
4. Examine at least two (2) types of biases that you likely experienced as you evaluated the premises for and against your position.   
5. Discuss the effects of your own enculturation or group identification that may have influenced your biases.
6. Discuss whether or not your thinking about the topic has changed after playing the “Believing Game,” even if your position on the issue has stayed the same.

The paper should follow guidelines for clear and organized writing: Include an introductory paragraph and concluding paragraph. Address main ideas in body paragraphs with a topic sentence and supporting sentences. Adhere to standard rules of English grammar, punctuation, mechanics, and spelling.

Your assignment must follow these formatting requirements: Be typed, double spaced, using Times New Roman font (size 12), with one-inch margins on all sides; citations and references must follow APA Style format.
