1.  Initially, Flash Parcel Service (FPS) built its advertising campaign around the slogan, “Our business quality speaks the language of speed.” Back then, the company was trying to make the customers aware of the speed with which it delivers the service. Later, FPS modified its slogan and designed new ads to make customers aware of the different aspects of its delivery such as reliability, cost-efficiency, and punctuality. By moving away from promoting itself as simply a parcel delivery company, FPS has:

used a repositioning strategy.

employed product class positioning.

engaged in positioning with cultural symbols.

adopted an undifferentiated strategy.

employed geographic segmentation.

2.

Ads that use telephone numbers that contain the company name are hoping to enhance:

selective sublimation.

selective bias.

selective determination.

selective retention.

selective understanding.

Submission Guidelines

All submissions are to be submitted through turn-it-in. Drop-boxes linked to turn-it-in will be set up in the Unit of Study Moodle account. Assignments not submitted through these drop- boxes will not be considered.

Submissions must be made by the due date and time (which will be in the session detailed above) and determined by the Unit facilitator. Submissions made after the due date and time will be penalized at the rate of 10% per day (including weekend days).

The turn-it-in similarity score will be used in determining the level if any of plagiarism. Turn-it-in will check conference web-sites, Journal articles, the Web and your own class member submissions for plagiarism. You can see your turn-it-in similarity score when you submit your assignment to the appropriate drop-box. If this is a concern you will have a chance to change your assignment and re-submit. However, re-submission is only allowed prior to the submission due date and time. After the due date and time have elapsed you cannot make re- submissions and you will have to live with the similarity score as there will be no chance for changing. Thus, plan early and submit early to take advantage of this feature. You can make multiple submissions, but please remember we only see the last submission, and the date and time you submitted will be taken from that submission. Your document should be a single word or pdf document containing your report.

1. If the guaranty agreement had not been in writing, would the agreement have been enforceable? Explain.
2. A guarantor can be required to pay a debt only after the principal debtor defaults. Which party was the principal debtor in this case?

In February 2005, defendant Nam Koo Kim (hereinafter the husband), as sole owner of
Majestic Group Korea, Ltd., entered into a loan agreement on behalf of the company with plaintiff [the Overseas Private Investment Corporation] to borrow $1,500,000 for the purposes of financing a “Ruby Tuesday’s” restaurant in South Korea. The husband and his wife, defendant Hee Sun Kim (hereinafter the wife), issued personal guaranties for the loan. In October 2005, Majestic defaulted on the loan and a restructured loan and assumption agreement was executed by the parties and included a promissory note by the husband to pay plaintiff $1,517,000 in the event of a default.
Once again, the wife agreed to personally guaranty the terms of the note and signed a written commitment to that effect. When the borrowers defaulted on the restructured loan, plaintiff, as was its right under the agreement, accelerated payments of the promissory note and commenced this action seeking recovery of the amount due under the note, together with interest and counsel fees. Plaintiff moved for summary judgment, and [the trial court granted the plaintiff’s motion].

Environmental regulations are not useful if they are not accepted and implemented globally. It requires commitment from the international community. According to the following Reuters article, “China represents just over 20 percent of global emissions while the United States accounting for 17.9 percent, Russia 7.5 percent and India 4.1 percent.†Do you think governments have responsibility to take the lead and impose regulations to curb the climate change?
