Evelyn works for NEC and her position includes the responsibility of interviewing and hiring all new employees. After reviewing Grace’s application and interviewing Grace, Evelyn denies her application for employment. Curious about the reason for her denial, Grace files a FOIA request with the IRS and learns that Evelyn had also filed a FOIA request for any information about Grace that the IRS holds. In response to her request, the IRS informed Grace that they gave Evelyn the following documents and information:
    1. Grace’s former home address
    2. Grace’s college transcripts that she provided the IRS at the time of application for her prior job
    3. A letter from Grace’s supervisor that recommended against hiring her for a position involving sensitive data
    4. A copy of the written decision of an ALJ in a case filed by Grace against the IRS in which she challenged the results of an audit done by the IRS on her own tax return. Grace appealed the initial decision in the audit to an ALJ. In the official decision, the ALJ ruled in favor of the IRS and ordered Grace to pay back taxes and interest penalties.
    5. The report of the internal investigation of Grace by the IRS concerning allegations involving two audits that Grace conducted for two taxpayers whom she appeared to know personally. The allegations suggested that the taxpayers and Grace stayed at the same hotel in the Bahamas, and flew to and from the Bahamas on the same flight (and were assigned three seats together on both flights), all of which occurred prior to the audit. Grace claimed that she did not know or remember the two taxpayers from the flights and thus did not recuse herself or turn their audits over to another auditor within the IRS. The investigation found insufficient evidence to cite her for a violation of internal, operational rules of the IRS. However, the report concluded as follows: “Although we uncovered no unreported income of the two taxpayers nor any undue influence on Grace as an auditor, we believe that she violated the spirit of the rules by not reporting her relationships prior to or in her final report of the audit.”
      • Grace comes to your attorney’s office and you are asked to write a memo explaining the Sunshine Laws, the FOIA, the Privacy Act, and whether she has any rights under either act that have been violated.
  2. Explain the conflicting values and limitations of each Act, and how they inter-relate to offset the negative values of the others. Then, starting with the FOIA, explain the major provisions of each act, citing and applying any specific rules or exceptions that may pertain to Grace’s case. Do the same with each Act. Further, if you find that any of Grace’s rights under these laws have been violated, state the remedies that are available to her. In order to survive, every organization must innovate and change. Just as change is inevitable, so also is the resistance to it. Most resistance to change come from those who are not involved in the innovation, therefore they prefer the status quo. A manager, or the innovator of change must, must however, not ignore the resistance for change. Oftentimes people who resist change have several reasons to do so. People have several reasons to resist changes that conflict with their self-interests, such as a job loss. The preeminent step in the implementation of change, is getting others to understand the need for the change in the first place. As a manager, once the reason for the resistance to change has been diagnosed, like a well-founded fear of job loss, I will go through the three stages of achieving behavioral and attitudinal change: The first stage is the Unfreezing. This is the stage where data are gathered and analyzed, and the awareness of the problem and the need for change would be brought to everyone’s attention. Next, I would introduce the intervention process, using emotion and logic to persuade them to accept the necessary change. The third stage would be the Freezing stage during which the change, if accepted, is rewarded.
Force-field analysis states that change is the “result of the competition between two driving and restraining forces.” Driving forces are the things that provide the motivation for change, while restraining forces are the barriers to change within an organization. Both the driving and restraining forces should be analyzed in order to have the ability to selectively remove the change-restraining forces, while strengthening those that enable the implementation of change.
In my company, the driving forces of change are those at the frontline of the operations, — the mid-managers, and those in direct contact with customers. They are the ones relating customer complaints, regarding perceived necessary operational changes to upper management. Although, looking at the organization from their perspective, those in the upper management believe that they are the driving forces for change. They made the decision to lay-off several seasonal employees in early September, in order to reduce payroll expenditure. However, the busiest season is not yet over, and the remaining sales associates notice the amount of revenue lost daily, due to employee shortage. Several customers, in different retail locations have complained about lack adequate amount of attention they always receive in our stores. It is very difficult to give the type of attention to details that each customer deserves, because there is usually one associate in each store daily. Unfortunately, customers are not the only ones affected by this practice, employee morale is also diminished.
