WRITE A 500-750 WORD ESSAY ON ONE OF THE FOLLOWING TOPICS:

1. Write a critical analysis of one of the assigned course syllabus readings from Weeks 1 or 2. An overview of approaches can be found here, but many are quite straightforward. Psychological, gender, sociological, biographical, and historical are all approaches that many use naturally in viewing a work. Whichever approach you choose, be sure to make the assigned readings your primary focus.

SUBMISSION INSTRUCTIONS

There is a 5-paragraph minimum requirement (an introduction w/ thesis, 3 or more body paragraphs, and a conclusion). Format in MLA style. Cite sources, both in-text and on the Works Cited page. The word count does not include formatting or Works Cited entries. Write in 3rd person. Avoid 1st person (I, we, our, etc.) and 2nd person (you, your).

In the upper left-hand corner, list your name, instructor’s name, course name and due date. Include a title. Double space lines and use one-inch margins around the paper. Use 12 Times New Roman font. Align left. Indent each paragraph 5 spaces. When quoting literature, research MLA citation standards for short stories, plays or poems.

All secondary sources must come from APUS library. Open web sources are not permitted. Do not create a “cut and paste” paper of information from various sources. Your ideas must be new and freshly constructed. Take great care not to plagiarize.

For all topics, create a debatable thesis (a thesis isn’t a fact, quote, or question). State your position on the topic. Present a new perspective on the assigned literature based on original observations.

Since the reader knows the story, avoid summary. Instead, focus on specific story elements that support your thesis.

Statement of Cash Flows Assessment – Accounting

You work at a company that manufactures low-cost computers and is currently considering entering India. Use the World Development Indicators (WDI) – the World Bank’s premier data compilation of data on development – to gather information on this country. Prepare a short report focusing on the economic policy and external debt, education, and infrastructure of India as it applies to your company’s product. Make sure you examine the trends India may have been experiencing over the past few years in your selected variables. Your report should be a maximum of 1 page, double-spaced, Word or PDF document. Short Analytical Essay with Research

The goal of this essay is to demonstrate your understanding of concepts of identity (based in course readings) by analyzing an incident (either historical or contemporary) of mistaken identity, identity deception, or identity confusion.You want to examine how other cases of mistaken identity (or identity confusion or deception) demonstrate the challenges of identifying, labeling, and explaining identity.This assignment will be completed in small steps that will culminate in the final essay of 5 pages.

Myths of Greeks (1200-1500 Words)

The sources that may be used are Sophocles’ Theban Plays [Oedipus, Oedipus at Colonus, Antigone], Aeschylus’ Oresteia [Agamemnon, Libation Bearers, Furies], Homer’s Iliad (selections available on Blackboard), Hesiod’s Theogony, Apollodorus’ Library, Hyginus’ Fabulae, and/or Ovid’s Metamorphoses, as appropriate for the topic. No secondary sources are to be used. You may use a maximum of two direct quotations. As in the other essays, the goal is to extract information and express it in your own words, while at the same time accurately directing the reader to the underlying source of information. Citations will follow the system used for ancient sources explained in the syllabus. The reference list may use MLA, APA, or Hesperia format.

The essay should be 1200-1500 words in length; it must be typed and double-spaced. Margins should be no greater than 1.5 inches on the left and no greater than 1 inch on the others. Use a 12-point font and black ink/toner only; do not use a cursive font. Be sure to include a separate “Work Cited” page with the title of the work in the appropriate format for the documentation style that you selected. In addition to the hard copy you will turn in to me, upload a copy to Turnitin.com and to Livetext.com, using the course information provided in the syllabus. The topics:

1) A very major issue seen in a number of myths examined in the last part of the course is the idea of fate or necessity. You must use some specific examples from the Sophocles’ Theban Plays and Aeschylus’ Oresteia, although you may use other myths as well. Explore how mythological characters are enmeshed in plots that turn on the idea of forces outside their control directing the eventual outcomes. Is there room here for the notion of free will and the belief that individuals have real control over their behavior and destiny? Can the characters be held responsible for their actions if they are in fact merely puppets of fate?

2) A number of mythographers have suggested that the notion of transgression lies at the heart of many Greek myths and that the most interesting characters are fundamentally transgressive in their actions. By “transgression” these critics mean ignoring or crossing normal social boundaries of behavior, normal gender roles, or atypical interactions with supernatural forces. Myths can then serve as a way for societies to think about deviant behavior and its consequences without actually engaging in transgressive acts themselves. Using specific examples, which important characters that have we seen can be labeled as “transgressive” and why do you classify them as transgressive? Are some characters more “transgressive” than others? You must deal with a minimum of five different characters.

NOTE CAREFULLY: page references are required with your documentation of modern sources, whether you employ MLA, APA, or Hesperia format. You are typically not citing science articles that are 1-4 pages long, so page numbers are necessary. Citations of ancient sources will follow the system I outline below and that we will practice in class. I will deduct five points from the paper grade for improper note or reference list format.

It is important to evaluate your collected evidence when considering the implementation of an evidence-based practice change.Two methods for evaluating evidence are systematic reviews and meta-analysis.Below is a summary and comparison of both.

Systematic reviews help summarize results of studies such as controlled trials (Cochrane Consumer Network [CCN], n.d.).They provide evidence of the effectiveness of the intervention that is being studied (CCN, n.d.).Systematic review is done using existing evidence to answer a clinical question and is unbiased (Bigby, 2014).

Meta-analysis is a systematic review that includes quantitative information of like-studies, to produce an overall summary (Bigby, 2014).Meta-Analysis is a good method to use when using statistical numbers that allow a summarization of study outcomes.When there are consistencies between studies, meta-analysis can identify the common aspect.

Meta-analysis and systematic review have some differences.Systematic reviews take findings for the whole range of relevant information of a topic (Akobeng, 2005).Meta-analysis on the other hand, adds a dimension of power and precision to estimates of the effects of treatments (Akobeng, 2005).The use of both of these methodologies when evaluating healthcare studies can be a powerful tool.

Evidence-based researches are always being conducted and it is crucial to find the most effective method to evaluate the evidences that are being published. We are encouraged to perform and practice based off of evidence-based research and for this reason thorough evaluation is much needed.

Systemic review is a type of review that is collected systematically to review a particular study, which can be either qualitative or quantitative. Systematic reviews are different from traditional narrative reviews. Systematic reviews, as the name implies, typically involve a detailed and comprehensive plan and search strategy derived a priori, with the goal of reducing bias by identifying, appraising, and synthesizing all relevant studies on a particular topic. Often, systematic reviews include a meta-analysis component, which involves using statistical techniques to synthesize the data from several studies into a single quantitative estimate or summary effect size (Uman, 2011).Meta analysis is a research process used to systematically synthesise or merge the findings of single, independent studies, using statistical methods to calculate an overall or ‘absolute’ effect (Shorten & Shorten, 2012). This process sees the overall findings and data of the studies to find the consistency and outcome of each study. From these multiple findings, an analysis can be designed. Both systemic review and meta analysis work together because without a systemic review, a meta analysis cannot be formulated. Meta analysis is finalized from numerous independent studies/reviews and finalized to oversee the overall trend and conclusion within the studies.

Two frequently used evidence evaluation methods are systematic review and meta-analysis. These two are often mentioned together and misunderstood as the same (Ahn & Kang, 2018). But they are actually different.

Systematic evaluation, also known as systematic review, refers to the process of applying a clear method, querying, selecting, and rigorously evaluating relevant research, extracting data from it, and combining the data using appropriate statistical methods to reach at a comprehensive conclusion. Systematic reviews can provide evidence to address a specific clinical problem. Others have defined the systematic review as rigorously summarizing and analyzing all studies on a particular problem using strategies or analytical methods that reduce bias.

Meta-analysis is also systematic reviews, which use a statistical method that combines the results of several studies into a single estimate in a literature review. Simply put, Meta analysis is a type of statistical method, with completely random design, factorial design, and so on. Meta-analysis (MA) may or may not be a subset of systematic reviews depending on the nature of the studies included in the review.

A systematic review does not necessarily require a meta-analysis. A systematic review with no meta-analysis and only descriptive analysis is called a qualitative systematic review. A systematic review of meta-analysis of multiple studies is called a quantitative system review (Rys et al., 2009).

But there are also different views that the definition of meta-analysis should be broader and equate it with systematic reviews. This idea is particularly widely used in the title of the literature. We can often see the title of the article as “meta analysis of a certain problem.” However, it should be noted that meta-analysis cannot be equal to systematic reviews.

    Assignment 1: The Masons’ New Car

    Note: The company mentioned herein is merely a hypothetical organization with characteristics developed to enable students to respond to the assignment. You may create and / or make all necessary assumptions needed for the completion of this assignment if those assumptions are consistent with the facts presented. Do not make assumptions which obviate the need to conduct a legal analysis of the issues.

    Scenario

    Earlier this year, Paul Mason and his wife Chardonnay Mason went to Rivertown and Gregory Ford, Dodge and Chryslers LLC. to purchase a new car. Last time the Masons bought a car was in 1990 when they bought their current car, a 1991 Plymouth Voyager van. The Mason’s daughter, Rosé recently gave birth to the Masons’ first grandchild and the proud grandparents were excited to be taking a road trip from Macon, Georgia to Freehold, New Jersey, to see the new addition to the Mason family. They knew that the old Plymouth had seen better days and that it might not make the 2,000 plus mile round-trip. The Masons were leaving for New Jersey in the morning, so they needed a new car and fast. When the Masons met with the salesperson at R&G, they explicitly stated that they were on a fixed income and could afford no more than $400 per month in the form of a car note. They were, however, willing to trade in their old van toward the purchase of the new car.

    Hector Dosales, one of R&G’s most aggressive salespersons, convinced the Masons to buy a new Chrysler 200. By the time the Masons were ready to buy, it was after 9:00 p.m. and the dealership was soon closing. To speed things along, Hector had the Masons sign blank form contracts that he would fill out the next day. Among the blank contracts that the Mason’s signed were a “Retail Installment Sales Contract”, a “Retail Buyer’s Order”, and an “Odometer Disclosure Form”. When Paul Mason asked about the terms of the deal, Hector said not to worry about it. He would structure things so that the payments would be under their $400 limit. When Paul asked how much he was getting for his trade-in, Hector said, “Don’t worry about it. I’ll make sure you get a fair price.” While the various forms were being signed, Chardonnay, who has a weak bladder, excused herself and in the confusion neglected to sign the Retail Buyer’s Order.

    The next day when Hector was filling out the sales documents, he was having difficulty getting the car payments under the $400 per month limit he had promised. While reviewing the forms, he noticed that the Odometer Disclosure Form indicated that the Masons’ van had only 58,528 miles on it. Due to the exceptionally low mileage on the vehicle, Hector was able to substantially raise the trade-in value, thereby reducing the car payments to just under $400 per month. The Odometer Disclosure Form had, in fact, been completed by Mary Jane, one of the clerks working at the dealership.

    After Hector had completed the sales documents and while the Masons were on their road trip, Hector attempted to place the sales documents with a third-party finance company. Because of the Masons’ low monthly income and poor credit history, no one was willing to purchase the contract. In the meantime, the Masons’ van was sent to auction. A Carfax report quickly indicated that the correct mileage on the vehicle was 154,000 miles not 54,528 miles. In fact, service records from R&G’s service department, where the Masons regularly brought the car for maintenance, clearly indicated that the car had over 100,000 miles on it. Because of the high mileage, the Van sold for $800 at auction, despite the $2,800 Hector had indicated as a trade value.

    When the Masons returned home, they were contacted by the service department of R&G and asked to bring in their new car for a complimentary service and detailing. When the Masons arrived, they surrendered the keys to the new Chrysler and were subsequently asked into a meeting with Hector and Felicia Fees, head of the finance department at R&G. Felicia informed the Masons that they did not qualify for financing the new car and that unless they had the cash to buy it, they would have to return the car. Of course, the Masons did not have the money to buy the car and told Felicia that they could just keep the car and they would take their old car back. Felicia informed the Mason’s that their van had already been sold at auction. Moreover, the Masons would be responsible for the usage of the new car at the standard lease mileage rates of .45c per mile. Since they drove the car 2,500 miles, they owed the dealership $1,125. Subtracting the $800 R&G received for the Masons’ van at auction, Felicia demanded payment from the Masons of $325. Needless to say, the Masons refused.

    The Masons have filed suit against R&G in Magistrate Court in Macon, Georgia, to recover the value of their van which they claimed to be the $2,800 Hector listed in the sales documents. (Magistrate Courts are low level courts that handle, among other things, small claims matters.) R&G has moved to dismiss the case and compel the Masons to arbitrate any claims they might have in accordance with the Arbitration clause contained in the Retail Buyer’s Order, which reads as follows:

    “Buyer and Dealer agree that all claims, demands, disputes and controversies of every kind or nature that may arise between them concerning any of the negotiations leading to the sale of the vehicle, the terms and provisions of the sale, the performance or condition of the vehicle, or any other aspects of the vehicle and its sale shall be settled by binding arbitration. … Without limiting the generality of the foregoing, it is the intention of the Buyer and the Dealer to resolve by binding arbitration all disputes between them concerning the vehicle, its sale and its condition, including disputes concerning the terms and conditions of the sale, the condition of the vehicle, any damage to the vehicle, the terms and meaning of any of the documents signed or given in connection with the sale, any representations, promises or omissions made in connection with negotiations for or sale of the vehicle, or any terms, conditions or representations made in connection with the financing, credit life insurance, disability insurance, and vehicle service contract purchased or obtained in connection with the vehicle.”

    The Retail Buyer’s Order also contained the following provisions:

    “If the purchase of the vehicle is being financed, Buyer understands that the sale is contingent upon obtaining approval of the financing by the financing agency. In the event that the vehicle has been delivered to Buyer but financing approval is not obtained, Buyer agrees to immediately return the vehicle to the Dealer.”

    Claims

    You are the Magistrate Judge in Macon County Georgia and have to decide this case. The Masons make the following claims in the complaint:

    1. There never was a contract in this case since the contract documents were not completed at the time they were signed. Since they did not contain the essential elements of a contract, no contract was formed.
    2. Since there was no contract, sale of the van was the tort of conversion and they are entitled to the value of the van which the defendant’s own statements value at $2,800.

    The defendant answered the complaint and moved to dismiss and to compel arbitration. The answer made the following statements:

    1. There was a contract because the actions of the parties indicated intent to make a contract.
    2. The Masons signed an arbitration agreement, and under the law are required to bring their claims before an arbitrator and not the courts.
    3. The Masons have been unjustly enriched by the use of the new Chrysler and must pay the reasonable value of that use.
    4. The Masons committed fraud by signing a false Odometer Disclosure Form. Because of their fraud, the Masons are estopped from recovering anything on the value of the van.

    Assignment Requirements

    Write a three to four (3-4) page court opinion in which you rule on this case. In preparing this opinion, you must:

    1. Decide whether this court should hear this case or dismiss the case and direct the parties to binding arbitration in accordance with the Retail Buyer’s Order. Support your response. 
      Note: Please read the facts of the case very carefully as you attempt to resolve this issue.
    2. Decide whether or not a contract exists between the Masons and R&G. Support your response. Note: Be sure that you analyze the facts to reach your conclusion. Merely stating your conclusion without a supporting legal analysis is not sufficient.
    3. Decide one (1) of the other remaining issues presented above. That is, decide whether R&G committed the tort of conversion with the 1990 van, or whether the Masons were unjustly enriched by the use of the new car, or whether the Masons committed fraud and should be estopped from recovering the value of the van.
