Identifying Themes,,,,

Assignment 2: Identifying Themes

Submit the following assignment to the M4: Assignment 2 Dropbox by Wednesday, June 18, 2014.

Identifying themes in your literature is very important because it helps you create a scaffold for your literature review. Without knowing themes, patterns, and trends, the literature review usually reads like a meaningless list with no connection between one study and the next. Also, without identification of themes, there is no appreciation of how scholars are actually having a conversation on paper regarding their discoveries.

By now you have taken part in multiple exercises and assignments which were intended to assist you in clarifying the themes you will pull together in and through your literature review. Now is the time to put pen to paper (or fingers to keyboard), and to take all of the preparatory work you have done and to actualize it in a draft of your literature review.

For this assignment, you will develop a Title page, Abstract, and a References page. Articulate your main research/focal question as the opening for your paper. Be sure it is specific, researchable, and important to the field. Then go on to list a detailed outline of the body of the paper, (including all headings and subheadings). Be sure to format your entire paper, including the headings and subheadings according to APA style.

Tort reform assignment

This week, we are covering torts and products liability. These types of suits are a significant concern for any business, and all businesses must understand their legal duties and work to limit potential liability as much as possible.

Over the last decade or so, many states have enacted “tort reform” laws in response to concerns that frivolous lawsuits were out of control and hindering economic growth. One case that become famous as the prime example of frivolous suits was the “McDonald’s Hot Coffee Case.” Many people have heard about the case, in which a woman filed a lawsuit of McDonalds after spilling hot coffee in her lap after going through the McDonald’s drive-thru.

Here is an example of an article discussing the case in the context frivolous lawsuits:

On the other hand, some argue that there is more to the case than most people know, and that the case has been unfairly used as the prototype of frivolous cases. In fact, a documentary was made about the movie. Below is a link to the documentary’s website, which includes some FAQs about the case:

http://www.hotcoffeethemovie.com/default.asp?pg=mcdonalds_case

After reviewing the links above, answer the following questions:

(1) Had you heard about the McDonald’s case before now? What were your perceptions about the case?

(2) Did you learn anything new from the FAQs from the documentary’s website? Does this new information impact your original views of the case?

(3) What is your view of the role of tort law–when do you think injured people should be able to pursue lawsuits to recover for their injuries?

(4) Overall, do you think tort litigation is a problem in the United States?

HCS 380 Discussion

# 1 Audits are part of a business manager’s experience. Sometimes employees are fearful during an audit. Employees who have not made intentional mistakes but never the less are concerned that an auditor might find things wrong can sometimes experience anxiety during audits. It’s good when employees are comfortable with their auditors, and when this is the case then audits can be more pleasant for everyone.

Unfortunately there are occasions when an employee might be doing the wrong thing with accounts, and when this is the case auditors can often sense that something is amiss before the wrongdoing is discovered. Wolfe and Ference (2013) recommend that auditors document the advice that they give clients. A case in point is one where the CPA verbally discussed weaknesses in a business’ accounts payable system only to discover some time later that embezzlement was going on by the CFO and vendors. A lawsuit resulted because the company said that the CPA never informed them of the weak A/P system (Wolfe & Beckett, 2013).

If auditors do document the advice they give clients on an informal basis, then I think this can be a good internal control for the business as well as protection for the CPA. When things are in writing, management has a due diligence to address and consider issues that they might otherwise put aside.

Class: Can you share your experiences of going through
an audit, or perhaps conversing with auditors? Please give examples of advice
they might have given you that helped you do a better job.
