El hombre es un animal cultural, esto es, un ser que, a la vez que incardinado en una
naturaleza sujeta a una legalidad necesaria, no se agota sin embargo en ella. Por el
contrario, mediante la pre-visión, —fondo subyacente de toda cultura—, aparecen en el
horizonte humano una multiplicidad de opciones, así como la capacidad para elegir de entre
ellas la que en cada momento se estima como más conveniente, rompiendo a través del
acto voluntario aquella normación implacable.
Ahora bien, al igual que el hombre se abre al mundo desde su biología, también dicha
biología condiciona el mareo de esa apertura. Queremos decir que únicamente nos cabe
llegar a alcanzar aquello que ese marco biológico nos posibilita. De ahí la relevancia y
significación que puede adquirir el olvido de tales márgenes, tanto para no devaluar nuestra
morfología natural en aras de mistificaciones epifenoménicas que sólo conducen a
ideaciones negadoras de la auténtica realidad del ser que somos, cuanto tampoco para
reducimos a una falsa mecanización de procesos físico-químicos, sujetos a esa elemental y
tosca dialéctica del estímulo-respuesta, que acaba convirtiendo al hombre precisamente en
lo que no es, en un mero animal.

Ahora bien, el que el hombre sea biología no significa que se agote en ella. El hombre es
también cultura, dato igualmente real y con el que, por lo tanto, hemos asimismo de contar.
La diferencia perceptual estriba en que la cultura no es, como la biología, algo sometible a
observación y medida en sí misma, antes bien una suerte de realidad que se encuentra
latente en aquélla en forma de capacidades, las cuales requieren a la vez de la historicidad
para manifestarse. Precisamente en el logro de esas capacidades consiste la acción humana.
Por eso, sólo cuando tales capacidades se hacen efectivas es cuando nos cabe hablar de
hombre. Capacidades, además, que son exigitivas en un doble sentido: como medios para
garantizar la sobrevivencia y, sobre todo, para colocarnos —rasgo este verdaderamente
original— en un universo de sentido. De hecho lo que separa al hombre de los demás
homínidos es, precisamente, ese poder suyo de crearse un medio, que es a lo que llamamos
mundo, dentro sólo de cuyos márgenes nos es dado habitar.
El hombre aparece así como un ser en tensión hacia el futuro, es decir, como proyecto.

An Unmanageable Case Management Quandary

You are the administrator for a court with 50 employees.
This court, which used to dispose of about 700 cases per month, now hears an
average of 100 criminal and 400 civil cases per month. Case filings have
doubled in the past 7 years. The present “hybrid” combination of the
individual and master case-management systems has evolved over a long period of
time through tradition and expediency. A growing caseload and increasing
difficulties in avoiding a backlog, however, have prompted the judges to
rethink their present system. Criminal cases that formerly reached final
disposition in 1 month now require 2 to 3 months. The situation shows no signs
of improving in the foreseeable future. Again, the court has a mixed calendar
system. Two judges are assigned to hear criminal cases and motions for a
1-month period, whereas the remaining four judges hear all manner of civil
cases on a random basis on the filing of civil complaints. The judges are
responsible for the management of these cases until final disposition. At the
end of the 1-month period, the two judges hearing criminal cases return to the
civil division and two other judges rotate onto the criminal bench; any pending
criminal cases or motions are then heard by these two incoming criminal judges.
One of the judges hears all juvenile-related cases in addition to any
assignment in the criminal and civil divisions. The court collects statistics
on the number of court filings and motions filed in each division on a
month-to-month basis.
