“The Right to Due Process” by Patricia Werhane,

“Rights in the Workplace” by Ian Maitland,

and “Case Study: Employee Relations at EDS”. (All of these readings are attached)

The primary issue concerning employment rights, is whether employees should have some kind of right to their jobs, or whether they can be terminated for a bad reason or even no reason at all. Werhane defends an employee’s right to due process, while Maitland rejects the idea that employees have employment rights.

Your discussion paper should respond to the following items/questions:
1) Who offers the strongest argument for or against employment rights, Werhane or Maitland? Explain that argument.
2) Do you believe that employees should have a right to due process in the workplace? Why or why not?
3) Consider the EDS case study. What does your view on employment rights suggest is the ethically correct thing for the company to do in this case?
