Many jurisdictions have adopted the Uniform Determination of Death Act, which provides that the individual has either 1) irreversible cessation of circulatory and respiratory functions, or 2) irreversible cessation of all function of the grain, including the brain stem. A criminal homicide must be the proximate result of the criminal act, and cannot be so remote that it is not the natural and probable consequence of the criminal act. Other time limits that may be established by statute, and how some states have abolished a time limit altogether as long as a causal connection can be established between the criminal act and resulting death. Along with the elements of the statute, the facts are critical to determining whether the elements can be met. For example, sometimes death occurs after the fatal injury, and in some cases, homicide prosecution under common law require that the death of the victim within a year and a day from the time that the ultimately fatal act took place.

For this assignment, research your state’s homicide laws using a statute list from your state’s government Web site. Review the list of homicide statutes to guide you in locating a state homicide case on point with one of the homicide statutes and complete to the following:

• Describe one type of homicide from your state statute.
• Explain the elements required to prove a violation of the statute selected.
• Explore a case that is based on a charge associated with your selection, including the facts of the case and the ruling of the court.

• Articulate why it is important for a law enforcement officer to understand the elements of the statute and the court’s interpretation of the statute when conducting an investigation of the crime.

jimmy Richardson is a 15-year-old Centervale high school freshman with no past criminal history. He currently works part-time at a

local retail establishment. The local police believe Richardson is involved with a local gang. They also suspect him of having used drugs

in school.

Richardson and a friend are caught stealing $150 from a
local gas station. The arresting officer smells alcohol on both
Richardson and his friend. Richardson expresses regret for his actions
and comments to the police and the court staff that he has been
depressed lately because of his parents’ impending divorce.

The judge presiding over Richardson’s case decides to
place Richardson on probation instead of sentencing him to confinement.
However, before this sentence can be finalized, a document called a
probation agreement needs to be prepared and authorized by the court.
Essentially, a probation agreement is a contract of sorts between the
probationer, the probationer’s parents (in the case of juvenile
probation), and the judge, and it outlines what is expected of the
juvenile while on probation.

Elements of the probation agreement generally include
basic information about the defendant (his or her name, the court out of
which the defendant is serving his or her probation, and the offense).
Other common elements are the general conditions of probation, which are
the terms, rules, and guidelines required of all probationers (these
are typically the same for all probation agreements within a particular
jurisdiction), and special conditions of probation, which are terms
specific to each individual probationer. Special conditions of probation
are based on the circumstances pertaining to the defendant’s arrest and
conviction.

Tasks:

Now, look through online sources to locate a specific economic policy in effect that you find interesting. It could relate to taxation, user fees, mortgage rates, minimum wage, or anything tied to US economic interest.

Then analyze it using the policy framework we have been discussing. (See lesson 4.) Consider effectiveness, efficiency, ethics, equity, political feasibility, social/cultural feasibility, etc.
