Legal Memo on Contracts
After having read chapter 27, use your knowledge on agency, your knowledge on the 4 elements of a valid contract and contract enforceability using either valid, voidable or void,and write a legal memo on showing why the contract between Stormy Daniels and Michael Cohen regarding President Trump was not valid. Below, I have given you the issue and the rule. You are to write the argument (you must demonstrate how each element was or was not met. For e.g., an agreement has 2 elements-offer and acceptance. Within that, you must prove if the 3 requirements of an offer was met. Only then can you move on to defining acceptance and proving if it existed. Furthermore, within your offer argument, you must discuss the type of agency relationship between Trump and Cohen and if he was authorized to make an offer). You must then write the conclusion. Issue: Whether the contract between Ms. Clifford and Mr. Cohen was valid when the contract was created for the purposes of President Trump influencing an election for which he was a candidate.
