HIPAA Privacy Rule

 Scenario No. 1: HIPAA Privacy Rule

Case Study: Imagine that you are the privacy officer for a small town hospital. You receive a report that there is a breach of privacy. You are informed that a 15-year-old girl is received at the emergency with an emergency labor. The baby is delivered in the emergency room as there is no time to move the patient to the obstetrics (OB) department. In addition to the emergency delivery, the baby is born with multiple medical problems. Once the mother and baby are moved to obstetrics and neonate, care is given to both.

The OB nurse who took care of the mother and baby completes her shift, and she goes home to her own daughter to have a talk with her. She sits her daughter down and pleads with the girl to tell her if she ever has any problems, especially when it comes to pregnancy. The nurse tells her daughter the story about the young patient who delivered that evening, and she accidentally mentions the patient’s name. The patient’s name is one of those odd names that immediately triggers the nurse’s daughter to relay that she knows the patient. The mother/nurse, realizing that she made a big mistake by mentioning the patient’s name, pleads with her daughter not to say anything. Needless to say, word shoots through the four high schools in the town the next day.

The nurse returns to work the following evening, and she contacts you to hand in her badge and keys, stating that she knows she made a mistake by breaching the young patient’s privacy and she knows she is going to be fired. In addition to the breach of the obstetrics nurse, you learn that the patient hid her pregnancy from her family, and to make matters worse, her aunt and mother are both nurses at the hospital. You know both of these nurses on a professional and personal level.

Then, perform additional research regarding the HIPAA Privacy Rule and prepare your Final Paper by analyzing the issues through these questions in regards to the above scenario:

Analyze the specific requirements needed to perform this investigation.

Identify whether this incident was an actual breach of privacy according to the HIPAA law.

Examine the differences and similarities between the hospital’s stance and HIPAA as to whether the nurse should be fired from her job.

Explain why you would fire or not fire the nurse immediately or whether you would put her on administrative leave awaiting the details of the investigatio

In your first essay, you will write a Summary Critique.  A Summary Critique involves summarizing and analyzing a text. Critique is, in a sense, argument about argument.  It is not about whether you agree or not with the authors.

Writing Project #1 | Summary Critique (10%)

Description:

In your first essay, you will write a Summary Critique.  A Summary Critique involves summarizing and analyzing a text. Critique is, in a sense, argument about argument.  It is not about whether you agree or not with the authors.  It is examining how an author makes his/her argument, and how well, given the audience he/she intends to reach.

The purpose of this assignment is to allow students to demonstrate an ability to:

  • Write coherent short essays, including creating a strong thesis, developing logical analysis and synthesis of their own ideas and others’, and organizing paragraphs with strong topic sentences and transitions;
  • Effectively write various expository genres, including summaries, analysis, synthesis, and argument;
  • Analyze and integrate academic sources;
  • Select appropriate and effective evidence to support their point of view;
  • Quote and/or paraphrase all sources accurately and correctly cite them using Modern Language Association (MLA) format;
  • Demonstrate a basic understanding of the writing process by effectively prewriting, drafting, revising, and proofreading for errors;
  • Demonstrate a heightened awareness of their most common grammar errors and apply an improved understanding of the rules of grammar in order to recognize and correct them.

Basic Structure:

Your essay should be 2-3 pages long and be double-spaced, with one inch margins on all sides and your name at the top of the first page. Your essay should include an introduction, a conclusion, and well-developed body paragraphs (2-3).  There should be a clear thesis statement in the introduction and clear topic sentences for each paragraph that relates to the thesis of the essay.

Introduction: Identify the author (full name) and title of the work (article titles will be in quotation marks and title case) and a general introduction to the article and its main point/goal.   At the end of the introduction, give your thesis statement which shows your answer to this question:  In your opinion, is the author successful in their writing of the article? (This is your thesis—the central claim that you will then go on to explain and defend).

Body:

  1. Summarize the work briefly in one paragraph;
  2. Critique #1 (Go on to critique the main points of the argument in 2-3 paragraphs. Make sure you consider the following: how are the author’s ideas presented? Does the author use good support? Given the audience you think the author is trying to reach, how successful is each point and the strategy he/she uses?)
  3. Critique #2

Conclusion

Process:

  1. Review the following text that we have discussed in class: “Balancing ‘No Blame’ with Accountability in Patient Safety.”
  2. Understand the text completely. Pay attention to how the authors structure their argument: what is their thesis? (It may or may not be stated clearly at the start); What evidence or reasoning does the author use to support that argument?
  3. Explain every point you make about the author’s writing thoroughly (not just what, but how and why.)
  4. Use paraphrases (no quotations) to provide evidence, examples, and explanations from the source.
  1. Provide an MLA works cited page at the end of the essay and use MLA format for in-text citations.

Follow this timeline to complete the writing process for this essay:

  • Summary: Your ability to clear express the main ideas of the text.
  • Analysis & Support: Your ability to deeply analyze ideas and adequately support your ideas with specific details, well-explained examples, and reliable research/evidence using correct citation format.

the history of the underserved population you identified in Week 2.

In your Cultural Competency Paper you will need to discuss the history of the underserved population you identified in Week 2.

This week we want to help you begin working on this section of your paper by researching and writing about the history of your underserved population.

Use the select questions (taken from the final paper assignment) below, to guide you:

  • How has this group been treated historically in our culture? What is the history (e.g., laws, experiences, etc.) related to this type of oppression? What assumptions, beliefs, or attributions appear to drive the oppression or discrimination of this group?
  • What are examples of specific oppressive or discriminatory practices that this group has encountered as they interact with various institutions? You may include social, economic, educational, faith, and health care institutions in your discussion, as well as any other institutions of relevance.
  • What examples of strength and resilience are, or have been, evident within members of this group?

Remember, when writing your papers please adhere to the following expectations:

  1. Organization – Five sentence paragraph with an introduction, three supporting sentences, and a conclusion sentence. Think about this same organization for your whole paper: five paragraphs in this paper, one paragraph as an introduction, three supporting paragraphs, and then your conclusion paragraph. (Please note: This format is only a suggestion, you may need more paragraphs to reach the expected length of each paper).
  2. Don’t rely too heavily on quotes. Take several articles and point them together into a unique way. We want your thinking supported by research. An example of this is to remember to paraphrase the work that you are researching and make it your words but still cite the source. We want to see more of your words and less quotes. When using the TurnItIn program the similarity should be 20% or less.

Your instructor will provide you with feedback that you can incorporate in your final paper.

Your Tasks:

This should be 1 – 2 pages long and should be APA formatted, making sure you use in-text citations for your references. You will be graded on content of the intervention and APA formatting.

I have attached 5 references that need to be incorporated in the paper.

This is a 6 page assignment. She want the class to do two pages a week. She gives instructions ever week who what she is looking for in the paper. So we have to do two pages every week.

Ryan is clearly in a difficult situation. She just started at a new company and is already contending with conflict. As she prepares for her difficult conversation with Gretchen, she is mindful of the fact that there will be a power differential between her and Gretchen. Why is power important to negotiations and this situation? What is the source of power that Ryan holds? Why?

  • When preparing for a difficult conversation, particularly when there is a power differential, it is important to practice or rehearse how you will open the conversation. Based on the facts, put yourself in Ryan’s shoes and compose a paragraph that you would state to Gretchen to start the conversation.
  • Another key factor in having a difficult conversation is preparing by having a list of questions ready for the other party. Prepare 5 questions for Ryan to ask Gretchen during the course of their conversation.
  • Ethics plays an important role in all aspects of negotiation and conflict resolution. Identify at least 3 ethical situations that are present or could arise based on the scenario. Explain why each issue is problematic and provide a way of either resolving or preventing it.

My topic is Abortion in South Africa”

Now that you have significantly researched your topic, write an issue paper of four to six pages where you consider the main points concerning your thesis.  Each point you consider should contribute substantially to the development and support of your thesis.  Significantly explain these points, including source origin and credibility, and discuss your strategy for addressing them in your essay:

  • What are the main points of your thesis?
  • What do these main points mean to your focus/claim and essay development?
  • Why do you consider the points you identify as crucial?
  • How will you address each main point in your essay?  At what point will you introduce each thesis point and how will each main point relate to one another?

Conclude with a thorough discussion of the nature of opposition (at least one potential counter argument) you have encountered regarding these points and the effect this opposition has had upon your thesis/essay development. Also, discuss how you will address the opposition of your thesis argument/your position on this topic. Please do not plagiarize because we have a system called Safe Assign and it will detect.

A summary of your chosen ethical issue (the problem)

You may not be personally in support of this issue, however it is your job to convince us of a supportive position. Include evidence why you you are taking an affirmative stance with this issue. Your presentation should include both audio and visual components. The visual component can be PowerPoint slides, graphics, etc and be no more than 10 minutes long. Only the first 10 minutes of your presentation will be graded if you go over the time limit. You must succinctly sum up your position.

  • A summary of your chosen ethical issue (the problem)
  • A brief description of the dilemmas or concerns involved (why is this a problem?)
  • Your rationale for a supportive stance on the issue.
  • Your proposed resolution.
  • The key stakeholders and factors in support of the issue resolution
  • Ethical principles involved (e.g., justice, autonomy, nonmaleficence, beneficence, veracity, etc.)
  • Any policy drivers related to the issue resolution such as access, quality, and cost
  • Any ethical theories that support your position
