After Good Grocers, Inc. expanded its organic produce section and adopted a “buy local” policy, sales increased. The Virginia-based chain expanded its retail locations from seven to twelve (7 to 12) over the last three (3) years.

As the Assistant Human Resources Manager, your job is to advise store managers about legal and personnel matters. The leadership at Good Grocers, Inc. considers you to be a legally astute manager, who consults with the corporation’s attorney, as necessary. The corporation’s leadership has tasked you with managing two (2) situations have come across your desk. Please respond with support that is backed by the law.

Write a three to four (3-4) page paper which addresses the two (2) situations from two (2) store managers.

Situation 1

Last week, my produce manager reported the following incident:

As I came out from the bakery, I saw a woman lying on the floor of the produce department. Her husband started yelling at me, saying, “She slipped on a banana peel and fell. My wife is the anchorwoman for NEWSNOW, and we are going to sue you!”

She didn’t look hurt, but I called 911 and filed an incident report that contained the facts of the situation. When viewing the area, I did, in fact, see a banana peel on the floor, but it was still yellow and lying on top of a ribbed rubber mat. The woman in question was wearing five-inch high heels. But I wasn’t sure what to say, other than the woman would be hearing from us.

  1. Explain whether this situation is best handled by litigation or by a particular form of alternative dispute resolution.
  2. Based on how you would handle this situation, either through litigation or a particular form of alternative dispute resolution, outline the key next steps involved in seeking a resolution. Justify your response.

Situation 2

Last week, my bakery manager was short an employee over Mother’s Day weekend when the bakery is always busy. To make up for being shorthanded, the bakery manager called in Ms. Greene, an independent contractor. Generally, Ms. Greene comes in on Monday, Wednesday, and Friday nights between 6 to 9 p.m. just to decorate cakes; she has her own bakery business. We furnish all of her equipment, and we pay her by the cake.

Ms. Greene worked eight (8) hours on Saturday and another eight (8) hours on Sunday over Mother’s Day weekend. We paid her $15.00 per hour. On the following Monday when Ms. Greene came in, she told me that she wanted to receive the same benefits as the other Good Grocers part-time employees, such as paid time off and employee discounts. Ms. Greene asserted that she really is a part-time employee who deserves the usual employee benefits.

3. Determine whether Ms. Greene is an independent contractor or a part-time employee. Provide a rationale for your response.

4. Explain the reasoning supporting whether or not Ms. Greene should receive the same benefits as part-time employees.

You are working in a 15-bed rural hospital with an emergency department. You are the only adult-geriatric provider on this shift, and you are presented with the following case.

A distraught older female brings by personal vehicle her husband of 60 years. This is an 81-year-old male farmer/rancher who was out branding cattle when he experienced new onset headache and difficulty using his right hand. He tried to call his wife on his cellphone but was unable to speak. Instead he blew into the phone and tried to make noises with his mouth. She went to the branding site and transported him to the emergency department.

He is somnolent but will awaken with stimulation. When awake, he is frustrated and tearful. His right hand is flaccid, and he is aphasic. Your facility has a full lab, full x-ray, and CT machine, but no MRI and no neurology consultation service. You are contractually connected with a tertiary care center that is also a stroke center.

ssume the perspective of Andy within this scenario. In keeping with Andy’s point of view, address the following: Define the concept of reasonableness.

Step 1 Consider the case study.

After graduating from college with a degree in nursing, Andy finds a solid job, gets married, and has two sons. Twelve years later, he moves to a position at another hospital promising him steady advancement within its managerial ranks. A devoted family man, Andy admires his wife’s dedication to raising their boys. But he also observes that his sons, approaching their teen years, benefit greatly from his fatherly friendship and counsel- especially as they approach what he and his wife realize could prove to be a difficult transitional period in their upbringing. So he has made a commitment to spend plenty of time with them, playing baseball and helping with their schoolwork. But he also loves his work, and does well at it. It has become apparent that to advance rapidly up the managerial ranks at this hospital, he should obtain a graduate degree. A nearby university offers the degree in an evening-and-weekend program that would allow him to continue full-time employment, but would soak up his free time for the next several years and throw most of the family activities into his wife’s hands.

Step 2 In your original post, address the following questions relating to the dialogue.

Assume the perspective of Andy within this scenario. In keeping with Andy’s point of view, address the following:

  • Define the concept of reasonableness.
  • Where should Andy focus his attention? Why?
  • How do you believe someone like Andy is capable of incorporating non-rational mental processes into his critical thought? How are we able to engage in this intense level of cognition?
  • What rational and emotional principles are at work in your view?

Most college instructors require students to turn off their cell phones in class so that their phones will not ring and also to prevent students from texting during class.

In this assignment, you will apply your knowledge of bias, perspective, and critical thought to a given example.

Step 1: Consider the scenario:

Most college instructors require students to turn off their cell phones in class so that their phones will not ring and also to prevent students from texting during class. The policy has become a serious point of contention among students, many of whom rely on cell phone applications to help organize their ever-changing schedules. Parents, too, have begun raising concerns over their children’s safety. Parents are worried that they will be unable to reach their children during an emergency if all phones are shut off. As a member of the College Board, it is your responsibility to read all such incoming mail. The following is a small sample:

Letter 1: Our civil liberties should never be subject to change. What the school board is attempting to do here is remind students that their rights can be given and taken away by authority. This particular case may be insignificant, but a larger philosophical debate regarding the inherent rights of the people is anything but minor.

Letter 2: I worked hard to get into college. The classroom encompasses everything I value in higher education. It is not the right place or time for students to be fiddling with their cell phones. As a student, I support the new initiative. I hope other students will understand why this move is so important.

Letter 3: I put my trust in the authority at hand. If school officials believe that having cell phones in the classroom is a distraction, I trust their judgment. The public is generally ignorant anyway, and it’s likely that they are expressing opinions out of emotion, not a sense of truth.

Step 2: Analyze different perspectives and biases.

In a two to three-page (minimum) written speech, to be given in front of an audience of parents and college faculty, in which you support the school’s decision to turn off cell phones during class, address the following. Use the aforementioned letters as examples to refute:

  • Identify evidence of bias in each of the three letters. How can you describe the notion of bias?
  • Define perspective. How does the concept of perspective influence the opinions of the speaker in each letter?
  • Is the school’s new proposal fair? Give your view with a set of arguments to support your view.
  • Give an opposing view to each letter and its arguments, and give your explanation for why your arguments should be more persuasive than the opposition’s.
  • Is there a bias at work in your view as well?
  • Briefly explain the perspectives of both sides of each argument. How does critical thought affect perspective?

2. Design relevant treatment plan

3. Link pathophysiologic concepts to medication choices

4. Collaborate without outside providers and resources

Activity Learning Outcomes

2.The patient is a 24-year-old man brought to your clinic by his family for an evaluation. The patient states that he is struggling with prescription pain pills and wants help. He appears to be in opioid withdrawal; he describes anorexia and diarrhea, he is yawning and sweating upon examination. He scores 15 on the Clinical Opioid Withdrawal Scale (COWS), indicating moderate withdrawal.
