Final Paper

You are the manager of Acme Fireworks, a fireworks retailer who sells fireworks, puts on ground display fireworks, and large aerial display fireworks. The company started in the owner’s garage two years ago and now has 15 employees that you manage. The company started as a sole proprietorship, and the owner has never changed the entity. The owner has informed you that the company has received inquiries from several large businesses wondering if the company could create several fireworks displays on a regular basis. The owner told the inquirers that the company could fill such display orders, and a price per display was agreed upon. It was discussed that most of the cost for a fireworks display is for skilled labor, insurance, and the actual service of setting off the fireworks. No other details were discussed. The owner is anticipating that new employees will need to be hired, but he is worried that if the large orders for fireworks displays do not continue, the company will not have the funds to pay the new employees. The owner is now considering changing the business entity, but he does not know what entity to form or how to form it.

The owner has asked you to do the following:

• Determine if the contracts with the businesses will be governed by common law or the Uniform Commercial Code (UCC), and explain why.
• Analyze whether the owner formed a contract with the businesses, and apply the five essential elements of an enforceable contract.
• Explain the potential personal liability to Acme Fireworks if a spectator is injured by a stray firework from a fireworks display.
• Discuss the different employment types and relationships relevant to agency law, and analyze the advantages and disadvantages of each type specific to Acme Fireworks.
• Explain why Acme Fireworks should not operate as a sole proprietorship. Recommend a new business entity, and provide rationale to support your recommendation.

For each task, be sure to analyze the relevant law, apply the facts to the law, and make a conclusion.

The paper

• Must be 8 to 10 double-spaced pages in length (not including title and references pages) and formatted according to APA style, Times New Roman font, 12 font size, double spaced
• Must include a separate title page with the following:
• Title of paper
• Student’s name
• Course name and number
• Instructor’s name
• Date submitted
• Must begin with an introductory paragraph that has a succinct thesis statement.
• Must address the topic of the paper with critical thought. That is, describe what your response is to the content, either positive or negative, and defend your position. If multiple options, alternatives, and/or positions are present and are being rejected, you must also defend the reasons for rejecting an option.
• Must end with a conclusion that reaffirms your thesis.
• Must include at least five scholarly sources
• Must document all sources in APA style 
• Must include a separate references page that is formatted according to APA style

Chapter
13 contains a project management framework consisting of the following
seven milestones to develop a QuickBooks accounting system: 

• Milestone 1:  Proposal

• Milestone 2:  Company Setup

• Milestone 3:  Lists

• Milestone 4:  Transactions

• Milestone 5:  Memorized Reports

• Milestone 6:  Documentation 

• Milestone 7:  Presentation 

The highlighted items below indicate what will be required for submission to the instructor. 

This
project provides an opportunity for realistic, valuable practical
experience to apply the concepts learned throughout this course and give
you the opportunity to get experience developing and writing a project
proposal. 

You
will follow the instructions given for each milestone in Chapter 13. 
There are few modifications to the instructions.  These exceptions
include:

• You will not need to submit each milestone to the instructor to be reviewed prior to proceeding with your next milestone. 

• You will not have to submit a QuickBooks in Action Project Approval form for any signatures.

• You
  will not actually be interviewing a real client, but rather you will
  come up with what specific accounting needs would be required for the
  client you identified. 

• You will not submit sample transaction results to the instructor or client for approval. 

• You will not obtain instructor or client approval for memorized reports.

• You will not presenting your project to your classmates.

You
will need to submit your project proposal as defined in milestone 1;
your client documentation that includes a history of the project
development and instructions the client will need, i.e. instructions
regarding how and when to back up and restore company files, as defined
in milestone 6; and your prototype or company’s chart of accounts
listing, customer listing, vendor listing, employee listing, and item
listing, and a general journal to display the sample transactions you
entered for milestone 4. To submit your work, click on the
View/Complete Assignment link.  Attach your document through the Browse
section and submit.  You will be attaching an Adobe (.pdf) or Excel
(.xls or .xlsx) containing the required reports depending on the what
format your instructor requires.  Your document will be sent directly to

After reading about the physical impairments related to age in Chapter 4 of the textbook and watching “Aging,” visit “Sociology of Aging: Age Related Impairments: A Simulation Exercise” and select at least two of the impairments that are listed in the exercise. After selecting the impairments that you will be simulating, use the household items that are listed and proceed with carrying out your normal tasks around your home. Then, describe which impairments you simulated and what you experienced. Answer the following questions:

1. What was it like to complete your tasks with the selected impairments?
2. What were the difficulties that you encountered while completing your tasks? Were any of those difficulties unexpected?
3. Have your thoughts or attitudes about older adults who have the impairments that you selected changed as a result of this exercise? Why or why not?
4. After having reviewed the required resources for this discussion, which of the major biological theories on aging do you think best explains the impairments that you simulated? Be sure to support your answer.

Changing an organization’s structure is sometimes necessary for success. Change management processes may include top-to-bottom changes in everything an organization does. The organizational redesign process facilitates understanding of how such changes are implemented. The case study “Performance Plus” presented below reinforces that concept.

First, analyze the facts within the case study. Answer the following questions within your analysis of the case study and your understanding of the theories of organizational redesign:

• What have been the main causes of the difficulties being experienced by Performance Plus team members?
• As general manager, what steps should Steve Cook take to ensure that the Performance Plus teams deliver a high-quality product on time?

Secondly, looking particularly at the Strong Bond question, provide a recommendation of how you would suggest that issue be resolved.

Consider the following questions while preparing the answers for the assignment. Apply these concepts to your assignment wherever appropriate.

• Do formal and informal design elements apply?
• Are there any challenges posed by organizational redesign?
• Are there any requirements for building coordination and teamwork taken into consideration?
• Are there any dynamics of changing the design of the organization that impact patterns of behavior?

STUDENT ONE:

There are two different types of assumptions reality and value. Reality is a belief about what is accurate and factual about the way we view things in the world. Value assumption our standard and morals of right and wrong. People usually learned this at a very young age. Everyone has different religions and standard. Something I would see as wrong the other people might not see it that way. Something as simple as laws some people would see it as a protection to the general safety and follow them others might not agree with them and not follow them.

STUDENT TWO:

The text defines two different forms of assumptions. One of those forms being the reality assumption; where one assumes how the world works or the beliefs one has about the reality of things (Dryer, 2011). These beliefs are established through our experiences and surrounding. For example, only smart people go to college. Next is the value assumption, which are the assumption one makes about the values and standards of the wrong and right way things should be (Dryer, 2011). We develop these values as adolescents, and they continue to grow as we do. Like should eat breakfast before noon or it’s not good for you.

The Nature vs. Nurture video was had many assumptions, insufficient evidence, and answered claims. I think the biggest and most important evidenced that is missing the an actually test like the Professor said that goes into the household and studies for a life time to see the cause and effects parental guidance. The actual evidence to prove which is true about the outcome of a child’s life whether it be the nature or the nurture of an individual. I think the assumptions are valid but not accurate because everyone is different, and some criminals are raised in the best homes they choose to do wrong on their own and vice versa. A child can experience and learn things from many places, and I think with those things plus what they take from home makes them who they are. Both are needed but there are still issues on which is more influential to your life.

STUDENT THREE:

Callable bonds are bonds that can be redeemed by the issuer prior to its maturity (Chen, 2019). In order to determine how many shares that can be converted, a conversion ratio is used. Having conversion options makes business more appealing for the person investing. Callable and convertible bonds are similar in that both of them carry special provisions that make it possible for these bonds to be terminated before their official expiration date (Ozyasar, 2018). Another thing to consider with conversion, the bonds can be called by the user at a certain price that protects the issuer from any crazy spikes in share price. As a bondholder, I would not convert these bonds when the price of the stock reached $22 until I know that the earnings will be more than that of the bonds. For example, LC bond with a $1000 par value that is convertible into common stock. The bond has a conversion ratio of 50 shares ($1000/50=$20).

STUDENT FOUR:

Companies like the Lion Corp. (LC) would issue a 30 year callable bond is for companies that are secure financially and are able to buy back their bonds. Callable bonds are good for investors, because they can earn a guaranteed income. As a bondholder I would not convert my bonds when the prices of stock reaches $22, because I would make sure that a return can be made.
