7-6. PLACEMENT IN THE GIFTED PROGRAM? (ISLLC STANDARD 3) You are a new principal of an elementary school, and your year has been going quite well. The faculty, students, and parents all like you and your leadership style. Unfortu nately, one of the board members, Arlene McDougal, has been making negative com— ments about your school. She doesn’t like the traffic congestion at dismissal time, and she keeps bringing that up at board meetings. You are aware of the traffic problem and have been working with the police de partment to come up with a solution. Unfortunately, the layout of the streets prevents any radical changes. The police agree that the current traffic plan is the best that anyone can do. The traffic problems are short-lived, and the neighbors know to avoid the school at dismissal time. Even though you have explained this to the board of education, Arlene continues to make negative comments at the board meetings. At a recent meeting, when Arlene started to complain about the traffic problems at your school and that you’re doing nothing to solve them, she even suggested that per haps the board has hired the wrong principal if you can’t solve problems like this. At this point, another board member, Bob Murphy, spoke in your defense. His comments quieted Arlene, as other board members agreed with him. The next morning you sent an e-mail to Bob thanking him for his support. Later that day, your gifted education teacher comes to you with a problem. Mr. and Mrs. Bob Murphy requested that their son be considered for the fifth-grade gifted program. The criteria for admission to the program include standardized test scores, teacher recommendation, parental recommendation, and straight A’s in all subjects. The Murphy child met all the criteria except the standardized test scores. The minimum is the 90th percentile, and young Murphy scored in the 85th percentile. The teacher explains that because he is the son of a board member, she thought it wise to bring this to your attention. There are 20 students who met the criteria and the gifted class size limit is 20. To complicate matters, there are five other students who scored at the 85th percentile. If you make an exception for young Murphy, you’d have to make an exception for five other children, thereby raising the gifted class size to 26. Obviously, this is way beyond the limit for the gifted class, but not enough to run two gifted classes. If it were anyone else, you could explain that the child didn’t meet the criteria, but knowing that Bob Murphy has supported you complicates matters. If it weren’t for Bob, you could be looking for a new job. In the past, the superintendent had been the victim of Arlene’s verbal attacks, and now he is reluctant to challenge her. He obviously is afraid of her ability to influence the other board members, and he is not going to put his job on the line to protect yours. You are not sure how Bob will handle the news that his son did not qualify for the gifted program. What should you do? “See That My Grave is Kept Clean” – Blind Lemon Jefferson (from “That Old Southern Sound”)

This song from the late-1920s features only Blind Lemon Jefferson singing and playing acoustic guitar. The song sounds kind of like a 12-bar blues form, but it may be slightly different (I think it is 16-bars?). BLJ seems to play around with the rhythm and tempo a bit as well (I thought this was really cool and a bit unexpected). This song sounds very different from the other blues we have heard so far; “Crazy Blues” or Jimmie Rodger’s “Blue Yodel.” CRAZY how much variety could be contained within a genre in such a short period of time! I chose to talk about this example because it makes it pretty clear that, while there was common ground between “hillbilly” recordings, urban and rural blues, there was also a lot of differences as well.

An Effective Training Evaluation Plan

You have just learned that your company is looking for ways to cut back expenses. One of the cost cutting measures being considered is to terminate the training department, as the company considers this an expense and they do not believe training is contributing to the profitability of the company. As the head of the training department it is your job to defend the value of the department. You realize that well trained employees perform their jobs more efficiently and consequently can contribute to higher productivity and profits for the company. One way to show the value of training is to have tools that will allow a manager to track the performance of an employee both before and after they have received training.

  • Report
    Write a report that will be shared with senior management on why training is a very important part of the company’s overall financial success. Discuss the advantages of having well-trained employees.
  • Evaluation Tool
    Using what you have learned about transfer training and the evaluation of training programs create an evaluation tool which can be used to evaluate how effective any given employee training program is in terms of:
  • Increasing the level of transfer of knowledge (knowledge retention)
  • Monitoring the effectiveness of the skill performance in the job performance improvement
  • Include common attributes in your evaluation tool which could be applicable to most employees at the organization such as: employees showing concern for saving the company money or consistently turning in error free work. Your training tool should contain a minimum of 10 evaluation criteria.

Your training evaluation tool must be included with your report defending the value of the training department. You know that your report will be shared with senior level managers and eventually to the board of directors. However, you are uncertain whether or not you will be allowed to present your work at a later time or in a different manner. Therefore it is important that your report is well written and professional.

  • Executive Summary highlighting all the factors in the scenario.
  • Justification of the importance of retaining the training department in the company and explanation of how the training department is important to the overall success of the company.

Is there Jurisdiction?

Look at the situations below and answer the question. Make sure to distinguish between subject matter and personal jurisdiction. Additionally, discuss the standard the court will use to determine whether jurisdiction exists.

Situation 1: Mike, a Utah resident, sues Jim, a Nevada resident for $60,000 in Nevada’s Federal District court for negligence (a state law civil suit). Jim argues that the case should be dismissed for a lack of subject matter jurisdiction. Is he right?

Situation 2: Bill, a California resident, sues Bob, also a California resident, for copyright infringement, a cause of action arising under federal law, in a Federal District Court in California. Bob argues that there is no subject matter jurisdiction. Is he right?

Situation 3: Billy, a Seattle, Washington resident, sues the Orange Corporation, a Texas corporation, under a breach of contract (a state law cause of action) in Washington State Court for $100,000. The Orange Corporation does most of its business in Texas. It is incorporated in Texas, and its corporate Headquarters are located in Dallas, Texas. However, the Orange Corporation does have a branch office in Seattle, Washington where it employs a single salesman. Additionally, the corporation advertises in the Seattle. The corporation argues that Washington lacks personal jurisdiction over the corporation. Is the corporation right? Assume for this question that Washington may exercise personal jurisdiction to the extent permitted by the Constitution of the United States. Be sure to list the standard the court will apply.

Situation 4: Same facts as above. Assume the court finds there is personal jurisdiction. Can the Orange Corporation have the case removed to federal court?

The PICOT statement

The first step of the EBP process is to develop a question from the nursing practice problem of interest.

Select a practice problem of interest to use as the focus of your research.

Start with the patient and identify the clinical problems or issues that arise from clinical care.

Following the PICOT format, write a PICOT statement in your selected practice problem area of interest, which is applicable to your proposed capstone project.

The PICOT statement will provide a framework for your capstone project (the project students must complete during their final course in the RN-BSN program of study).

Conduct a literature search to locate research articles focused on your selected practice problem of interest. This literature search should include both quantitative and qualitative peer-reviewed research articles to support your practice problem.

Select six peer-reviewed research articles which will be utilized through the next 5 weeks as reference sources. Be sure that some of the articles use qualitative research and that some use quantitative research. Create a reference list in which the six articles are listed. Beneath each reference include the article’s abstract. The completed assignment should have a title page and a reference list with abstracts.

Suggestions for locating qualitative and quantitative research articles from credible sources:

  1. Use a library database such as CINAHL Complete for your search.
  2. Using the advanced search page check the box beside “Research Article” in the “Limit Your Results” section.
  3. When setting up the search you can type your topic in the top box, then add quantitative or qualitative as a search term in one of the lower boxes. Research articles often are described as qualitative or quantitative.

Read the Course Case Study and analyze the behavior of the counselor, as a professional, which you consider unethical or unprofessional. Write a brief summary of the unbecoming behavior. Substantiate the summary with reasons for your analysis.  

Then, examine the influence of your own personal values as it relates to the issues presented in the case. Write a brief summary of how your own personal values could influence you if you were the counselor in the case study.

Next, focusing specifically on the issue of imposing values on clients, identify how the counselor may have been in violation of the ACA Code of Ethics. Give the number and definition of specific violations and compare these violations to the APA ethical standards. Remember – only list those which are related to the imposition of the counselor’s value system onto the client.
