This is the second forum in which you’ll comment extensively and analytically on a paper written by a student. This paper is a paper written by one of my own students from two semesters ago.

Please remember: there are three primary ways that writers get better at writing: 1) they write often, 2) they get honest reactions from readers of their writing, and 3) they read a lot, especially of the kinds of writing they want to do well. This activity is where you aim to do focused practical reading of an example of a research paper by Mercy Gresham entitled “How Pornography Affects the Brain.” This paper can be found as a PDF in Module 3 and found as an attachment at the bottom of these directions.

The questions for this activity are what exactly is this paper doing? What is its design? How does it work?

The goals of this activity is a) to practice close analytic reading from the perspective of a writer, b) to see what a paper can look like, and c) to sharpen your analytical reading of academic argument.

  • Always aim to use paragraphs (Note: paragraph = 5-8 sentences), complete sentences, and well-developed thoughts.

1. A well-executed academic paper generally begins with a problem it wants to tackle. But Gresham’s introduction seems to have more than one problem. So what’s the best way to understand how she structures her introduction? And what exact problem is she addressing (and what’s the other problem)?

2. Surely, if pornography is bad, it’s bad for everyone. So how exactly does Gresham justify her focus on adolescents? Is it convincing? Why or why not?

3) She uses the words of Ted Bundy, a serial killer, as support for her argument. Why should we trust the view of a serial killer? Does Gresham take Bundy at his word? How does she want us to take Bundy’s claim?

4) How is Judith Hill’s position supposed to support Gresham’s argument? What does Hill’s idea do for Gresham? Be VERY specific here. Do you agree with how others characterize how Hill supports Gresham?

5) How do the results of the study on the ”Massive Exposure Group” support (if it does) or challenge (if it does) Hill’s position? Explain in detail. Do you agree with what others claim about this relationship between the study and Hill’s view?

6) Gresham notes, in her concession, that the psychoanalytic position offers a kind of “defense” for pornography. What is that defense and how does Gresham refute it? Is Gresham right about the psychoanalytic view being a mistake?

7) Where do you see really good uses of the “They Say, I Say” technique for using sources? Do you see places she’s especially good at it? How about points in her paper where the technique doesn’t work very well?

CASE STUDY:

Following a representation election campaign in which the union was elected by a majority vote to represent a group of company employees, the employer was found guilty of unlawfully discharging 20 employees during the election campaign for engaging in lawful union organizing activities. The employer entered into a voluntary settlement agreement with the National Labor Relations Board (NLRB), agreeing to reinstate and pay a certain amount of back pay to each illegally discharged person. After the NLRB reviewed approved the proposed voluntary settlement agreement, the employer refused to comply with the terms of the agreement it had negotiated with the NLRB because the company claimed to have evidence that many of the affected individuals were illegal immigrants. According to the employer, if the affected individuals were to be reinstated, the employer would be in violation of both federal (Immigration and Reform Control Act of 1986) and state (the Legal Arizona Workers Act) immigration laws. Both of these laws prohibit the hiring of unauthorized aliens.

The general counsel of the NLRB petitioned the court for an order enforcing the terms of the voluntary settlement agreement. The employer originally hired these individuals and admitted illegally discharging them during the course of the union organizing campaign. The employer voluntarily entered into the settlement agreement approved by the NLRB and did not at the time raise any claim that the affected individuals were illegal aliens. In order to effectively remedy an unlawful discharge by putting the individual back in the place they should have been absent their unlawful termination, reinstatement to their former job or a substantially equivalent one and compensation in the form of back pay for economic losses suffered as a direct result of the illegal employer action is an appropriate remedy and should be enforced by the court.

As a matter of public policy, should an employee be required to reinstate an unlawfully terminated employee even when that person is an illegal alien? Project 1 is designed to help prepare you for the final project at the end of the semester. You will notice that, for your final project in this course, you will be asked to trace a crime or criminal incident through the adult criminal justice system, from initial arrest to the eventual return to the community following incarceration. One of the first things I learned after being appointed president of Strong Memorial Hospital in Rochester, NY, was to deal openly with patients and families (and the community) when we made mistakes. Here’s one example that has always stuck with me: A 6-year-old patient with a defect in bowel function was hospitalized for severe constipation. He was given a dose of neostigmine (a drug that helps muscles contract and relax to move food through the system) that was 10 times the normal amount because of a decimal point error made by the resident who ordered the drug. Instead of 0.4 mg, the patient received 4.0 mg. Tragically, the patient died the same day from the overdose. My human resources director advised me to immediately hold a press conference to announce our mistake. I did. The conference lasted for two hours and centered on reporter questions about why the resident and nurse had not been fired. I explained that both were highly regarded and that the problem was a “system” problem, not a problem of an incompetent physician or nurse. I explained that we should have a fail-safe system in place to prevent such a mistake. (Today, hospitals have electronic medication error avoidance systems. We didn’t have that in 1984.) I indicated to the reporters that we would be examining the medication administration procedures in place from the point the medicine is ordered to the time it was given, and would put in place a procedure or procedures to ensure that such an error would not happen again. This story contrasted sharply with an experience I had with a wealthy patient from Geneva, Switzerland, who came over to the states each year for a comprehensive examination. Before coming to Rochester after his overseas flight, his routine was to spend a few days in New York City and visit friends. On one such annual trip, he fell while walking along a street in New York, fracturing his pelvis. He was admitted to a well-known hospital and spent three weeks recovering in bed. After three weeks, I received a call from him asking to be transferred to Strong Memorial Hospital in Rochester. He was unhappy with his care, indicating that no one seemed to be attending to him. We arranged the transfer and, when I saw him that afternoon, I was astounded to find that he had a pressure ulcer on his heel that was an inch deep. The ulcer wouldn’t heal, so I secured a vascular surgeon to perform arterial bypass surgery. The surgery, which improved circulation in the patient’s leg, was successful and, after a period of weeks, the ulcer healed completely. I wrote a letter to the president of the New York hospital to discuss the patient’s care. Some weeks later, after not receiving a response, I called his office. I was transferred to the hospital lawyer. I indicated the reason for the call and asked why I had not received a response. He said, “Oh, we would never acknowledge a mistake. We might get sued.”
