the question and the expectation are in the requiremetns section.

In 1984, the New York Times published the following article:

‘A new era for American telecommunications and for American business begins today as the once-unified Bell System begins life as eight separate companies. It is a time of great expectations and great concern for both the telephone industry and the nation as a whole.

No company so large and technologically integrated as the Bell System has ever split itself into pieces before, not even in the great trust-busting days early in the century.

No nation has ever made a determination to let the forces of competition, rather than government-backed monopoly, determine the future of something so vital as its telephone network. It is an especially daring course for the nation that, by almost all accounts, already has the best phone system in the world. If the gamble is lost, quality of telephone service could deteriorate.

”To break up a very tight network is something quite unprecedented,” said Alfred D. Chandler Jr., professor of business history at the Harvard Business School. ”It was one of the best managed companies in the world for a long time. You go overseas and people there can’t understand why we’re breaking up A.T.&T.”

That was an initiative to break a government- support monopoly in telecommunications, with the entry of new companies in the sector, and the belief that eliminating the monopoly would promote competitive pricing.

Can you identify other legal monopolies currently existing in the USA legal monopoly, based on economies of scale, that could be split into more firms to foster competition?. What do you anticipate would happen to prices? And how about the level of efficiency of the service provided.

week 7 leg 500

WEEK 7 DISCUSSION – “Stare Decisis” and the “Judicial System” Please respond to the following:

  • Define and explain what personal jurisdiction and subject matter jurisdiction mean and how these terms are relevant to one who does business in different states. What about a business that engages in international dealings, which court could the business be sued in and why? Provide support for your answers.
  • Each year, the U.S. Supreme Court issues around 100 legal decisions. The decisions are final interpretations of the law because of the Doctrine of Stare Decisis. Explain Stare Decisis and select one U.S. Supreme Court decision issued in the past year relating to the regulation of business or likely to influence business today and provide your thoughts on whether you agreed or disagreed with the Court’s opinion. Support your position and include your sources for information and cases. Remember the focus of this discussion is how the decisions by the Supreme Court can affect a business and doing business today! …….. This is the student response The two types of court jurisdictions in the US are personal jurisdiction and subject matter jurisdiction. These differ in certain aspects, such as:
    • Personal jurisdiction states that a court has power over people sued. This means that courts have the right to make decisions for the solicited person in their best interests. It is more difficult to determine. It has four categories, which are presence, domicile, consent, and minimum contacts.
    • Subject matter jurisdiction is more apparent than the other type of jurisdiction, for it is easier to determine. In this jurisdiction, the court has the power to hear cases of a specific subject matter, such as a domestic violence court has the potential to listen to domestic violence cases.

The doctrine of the Stare decisis signifies “to stand by things decided.” It refers to a principle that is pre-stated but can be changed in the future. In a case, courts have to look in the past a similar scenario to have a guide for their verdict (precedent). This doctrine is used in all types of courts and jurisdictions. The inner meaning of this doctrine is that courts must look for any precedent of the case when making a decision. An example is the case of Brown v. Board of Education of Topeka. The case was about racial segregation in public schools. The case was relying on the precedent of the Plessy v. Ferguson, which refers to the statement that racial discrimination is not a violation of the Fourteenth Amendment. System Recommendation Report (SRR), Section II – Sharing Data

Section II of the SRR document addresses the need for the Midtown Family Clinic to share data with other organizations. As part of analyzing the requirements for the new system, one step is to consider how that system will enable the Midtown Family Clinic to exchange electronic data with other health organizations – such as other providers, pharmacies, insurance companies, and even patients themselves. The case study mentions several of these. For this assignment you will select two types of external organizations and describe what kind of data would flow between the Midtown Family Clinic and those organizations and how that can be done effectively.

Formatting Your Assignment

For academic writing, the writer is expected to write in the third person. In third person, the writer avoids the pronouns I, we, my, you, your, and ours. The third person is used to make the writing more objective by taking the individual, the “self,” out of the writing. This method is very helpful for academic writing, a form in which facts, not opinion, drive the tone of the text. Writing in the third person allows the writer to come across as unbiased and thus more informed. The Report is to be written for the Midtown Family Clinic, and reference should not be made by name to individuals who own or work in the Clinic.

  • Include the Introduction and Section I, revised according to any feedback received, and add to it Section II.
  • Write a short concise paper:Use the recommendations provided in each area for length of response.Content areas should be double spaced; table entries should be single-spaced. It’s important to value quality over quantity.Section II should not exceed 4 pages.
  • Ensure that the table is preceded by an introductory sentence that explains what is contained in the table, so the reader understands why the table has been included.
  • Use at least two resources with APA formatted citation and reference.Use at least one external reference and one from the course content.

Write an approximately 1-3 page paper

Write an approximately 1-3 page paper based on your research on your text and/or topic. Consider the role rhetoric plays in it or how it is constructed to influence. Your research should include the following:

a) An explanation of the significance of your topic/artifact. If I were researching American Idol, for example, I would find research that indicated how many people watch the show each week, how many seasons it has been on, how many awards it has won, and what its impact on popular culture has been.

b) An explanation of what others (especially scholars) have said about your topic. Some have said, for example, that American Idol perpetuates consumption due to its frequent product placement, while others have said it promotes democratic participation.

For this paper, you should integrate this research to construct an argument as to why your topic is an important one to study and what the purpose of your original research is by using your research to:

a) Explain the significance of your topic,

b) Explain what others have said about it, and

c) Explain the purpose of your original research, i.e., what you hope to find out as a result of your original research.
