Description, Purpose, and Relevance

Our purpose this semester has been to understand marginality as a real social, economic, and cultural phenomenon within the Appalachian context, and more specifically in relation to Birmingham Alabama . With the synthesis essay, you learned how to establish and join the scholarly conversation on the topic that you have chosen for this semester. Its purpose was mainly to provide an overview of the issues pertaining to your topic. The purpose of this assignment is to engage you in exploring the various arguments that relate to your topic, and then, on the basis of your research, to identify an argumentative position based on the evidence that you have gathered.

With the synthesis essay, you mainly established the context of the topic, without necessarily focusing on Birmingham or Appalachia; however, with this assignment, you want to narrow the focus of your topic by identifying a specific issue in a specific context based on what your sources tell you. For instance, if your topic is international students on American college campuses, you will now have to focus more specifically on an issue or a problem that they face due to which they may feel marginalized. The best way to identify these problems/issues is to conduct research. In order to make the argument more specifically about Birmingham , you will use primary research by interviewing/observing members of the UAB community.

Argumentation is more than just a difference of opinion; it is significant for understanding different perspectives, evaluating the basis for different positions, eliminating fallacies, and arriving at an educated position based on the evidence from research. An academic argument does not just address an academic audience, but also emphasizes the importance of evidence-based approach. In keeping with the AGSC guidelines, the assignment aims at enabling you to develop the skills of critical thinking and argumentation by engaging in primary and secondary research, engage thoroughly in the processes of writing, demonstrate your knowledge of conventions, and most importantly, learn to explore writing as a means of self-discovery and communication. Ultimately, however, the purpose of the assignment is more than just academic exercise; it is an attempt to empower your voices as you learn to take a position on a topic backed by evidence.

Timeline

2/17: make an annotated bibliography of 5-6 sources (4-5 secondary and 1-2 primary sources); Please submit your annotated bibliography of at least 5 sources for the academic argument essay. You can use some of the sources that you gathered for essay 1, but need to add more to them. First, create a bibliography and then add the annotations to explain what each source is about, why you chose it, and how you plan on using it in your essay.

2/21: make an outline of the argumentative essay; without such an outline, it is easy to drift away from your main argument.

2/24: write out the introduction and one of the body paragraphs for an informal class discussion and review; we will devote the entire class time to reviewing and addressing questions (good day to bring laptops).

Structure

As we learn the basics of argumentation and academic research, we will also learn how we might structure and develop arguments for our audiences. As we will see, there are many ways to invent and structure arguments.

Introduction: Your audience may not know the context of your issue or how the debate has taken place and the different positions on the issue. You will definitely want to set up this context in the introduction of your essay. In addition, you will want to develop your purpose by explaining to your audience how your perspective on the issue connects to or advances their understanding of the issue. Draw from the rich context of your synthesis essay to develop your discussion of these perspectives. Your introduction should demonstrate that you are entering a conversation that includes competing perspectives.

Thesis: At the end of the introduction, you will want to develop an arguable thesis that clearly maps out your focused claim about the issue, supports this claim with reason(s) and evidence. In addition, you will want to lead up to your thesis in a way that shows how your claim connects to the context or ongoing discussion of the issue.

Body Paragraphs: Each of your body paragraphs will need to have a strong Point or Topic Sentence that states the main idea of the paragraph and establishes how this idea supports the thesis. In each body paragraph, your purpose will be to provide a precise Reason that supports your thesis. In addition, you will need to draw heavily on your research for Evidence that support the arguments of your paragraphs. This is crucial to arguing your position successfully. In addition, you will want to develop Explanations/Concluding Ideas that explain your illustrations and also help your paragraphs pass the “So What?” test by pointing to the importance of the information in the paragraph for your thesis.

Body Paragraphs: In addition to the elements above, you will need to develop one or two body paragraphs that anticipate objections from your audience, and provide significant refutations to strengthen your position. This means that you will want to explain to your readers why these counter-arguments do not weaken or disqualify your position, or why they should still accept your argument.

Conclusion: The conclusions to arguments are crucial, as they are often the place where the author spells out the implications of their arguments. This means that the author connects the argument to the real world of the reader, informing them of the applications of the arguments for their own lives or perspectives. While this essay does not require you to recommend solutions or courses of action, you may want to emphasize the need for action.

Concepts of Contemporary Democratic Governance

The concept of democracy is not unique or original to the United States. The first documented democratic society was ancient Greece. Ancient Greece actually had a combination direct democracy and representative democracy. A representative democracy is one where the citizens elect representatives to vote on issues for them and a direct democracy is one where all citizens can vote on issues. While direct democracy sounds good, it is difficult to implement because of the potentially high number of people involved. On the other hand, not everyone who lived in Greece was a citizen; large groups were not eligible such as women, slaves, and non-landowners. Likewise, there are aspects of constitutional democracy to consider when reflecting on the state of democratic governance. Background: Jurisdiction in the courts is an aspect of the law that can be confusing and complicated, but it is an important legal concept that businesses cannot ignore. Jurisdiction can affect many business operations and determine various business decisions, such as where and how to advertise and market the business. Before launching a business, and where there are questions about possible jurisdiction in the courts, it is advisable for businesses to consult an attorney.

To help educate the GC owners about jurisdiction, you prepare a presentation for Connor, Ali, Madison, and Sam to be discussed at a meeting with Winnie, Ralph and the GC owners.

You prepared the following example for the meeting presentation and discussion.

Example Scenario Facts: Assume GC advertises aggressively in the Middle Atlantic States of Maryland, Delaware, Pennsylvania, West Virginia and Virginia. GC also advertises regularly via the internet soliciting business in all states.

Assume GC contracted with ABC Corporation (ABC), incorporated in Virginia to clean the company offices in Richmond, Virginia. ABC paid for the cleaning, but after the cleaning, ABC was dissatisfied and sued GC in Virginia to recover the costs of the cleaning. It was determined that the Virginia state court had jurisdiction to hear the case.

“Virginia court has the right to hear the case against GC and ABC. ABC saw the marketing from GC and determined that they were qualified to perform the job. Since ABC is incorporated in Virginia, due to jurisdiction rights they have the right to file in Virginia because that is where they are incorporated and conduct business. Since GC marketed outside of their own state, they assumed liability. When a company uses the internet to market in other states, it’s the use of the internet opens them up to liability suits in any jurisdiction that the client resides in due to business planning efforts (FindLaw, 2019). When starting a business, it is important to be aware of the implications of marketing in other states and the liability they open themselves up to when they reach into the jurisdiction of another state since the laws vary among states.

It is determined that the state in which the business was conducted (FindLaw, 2019). In this scenario, when GC advertised in Maryland, Delaware, Pennsylvania, West Virginia, and Virginia they opened themselves up to those states laws. Jurisdiction is the right for a state to govern a business’s contracts (Introduction to Law and Legal Systems, 2014), and the contract that was written was for the company in Virginia, therefore Virginia has the right to claim jurisdiction. Part 1.03 [Personal Jurisdiction Based on Conduct] as stated in The Uniform Interstate and International Procedure Act states the states court may proceed on the grounds that the action in question performed its business in the state, which GC performed the business in Virginia (FindLaw, 2019). It also correlates to the fact the GC promised to supply a service in the state, binding it to the jurisdiction (Findlaw, 2019).

Case Information

Fran S. was arrested for prescription fraud when she tried to obtain prescription painkillers at a pharmacy with a fake prescription. You have been asked to assess her situation and make treatment recommendations to the court.

Fran S. is a 32-year-old employee at a local bank. She was briefly hospitalized after a car accident 14 months ago and sustained injuries to her neck and back. Her doctor prescribed painkillers for these injuries. He told her that she should only take the painkillers for a few months, but Fran found that she liked the feelings of calm and relaxation that the painkillers produced. Even though the pain from her neck and back went away, she kept telling her doctor that she was in pain so that he would continue prescribing the drugs. When her own doctor told her that he would no longer prescribe the painkillers for her, she found it difficult to go for more than a few days without the painkillers (she reported feeling anxious, irritable, and “not herself” when she stopped taking them) and found another doctor who would prescribe her painkillers.

Fran told herself that the painkillers helped her get through her day, but she started missing deadlines at work and repeatedly coming in late, putting her job in jeopardy. Her husband also reported a difference in her behavior, saying that she was detached, much more irritable and likely to start arguments over minor issues, which had not been a problem in the past. Fran started taking larger doses of the painkillers because she had stopped feeling their effects at the smaller doses. Her second doctor became suspicious of how frequently she needed prescriptions and refused to prescribe her any more drugs. Fran tried again to stop using the painkillers but found that she was experiencing problems, such as headaches, blurred vision, and anxiety, when she was not taking the painkillers. She could not find another doctor to prescribe her the painkillers, so Fran started submitting fake prescriptions to the pharmacy.
