Discussion: Interpreting in International Courts and Tribunals

Read

The first article analyzes the enforcement of international law in U.S. courts (the most easily accessed for U.S. citizens living domestically). With direct private rights of actions in domestic courts having been called into question, what is the best way for the domestic court to allow treaties to be used? The authors describe three methods: indirect enforcement, defensive enforcement, and interpretive enforcement. The second article discusses the enforcement, or lack thereof, of international law on an international scale.

Discuss

  • Does the use of the suggested domestic methods place too much power to the courts thereby granting them powers outside that set forth in the Constitution?
    • Why or why not?
  • Should the decision as to whether international law is enforceable domestically rest with Congress?
    • The President?
    • Evaluate the three methods for constitutionality.
  • Is international enforcement any more effective?
    • Discuss the pros and cons of both domestic and international enforcement.

Prewriting and Research Packet – Research and Writing

I’ve listed my topic and some supporting documentation. Can be reached for any additional information they may be needed.

Topic:

My topic is should Blue fin tuna fishing be temporarily banned.

Position:

People should eat less blue fin tuna products because we are slowly killing off their species with commercial fishing.

Audience Description:

The audience for my essay will have an affection for sea life and the ocean’s environmental health. They will be consumers of seafood, but not necessarily tuna fish. They may be avid wild life activists and true nature lovers. They could be strongly opposed to the current practices of commercial fishing but are not aware of the current affects. Since most people eat some form of fish they may be entertained about the idea of how their tuna is captured and prepared. Some people may care less and only be concerned about the price they pay as a consumer. Some may object my argument because they don’t care or either don’t consume seafood. My beliefs are that if we continue to over fish a particular species, no matter how high the demand, we are only causing long term issues to the ecosystem and the blue fin tuna.

Goal:

My goal is to make consumers aware of the long term damage commercial fisheries have on the blue fin tuna species if we don’t make drastic changes to the quota system.

Topic:

My topic is should Blue fin tuna fishing be temporarily banned.

Position:

People should eat less blue fin tuna products because we are slowly killing off their species with commercial fishing.

Supporting Points:

I. Current blue fin tuna populations are diminishing at an alarming rate due to commercial over fishing.

II. The demand for blue fin tin overseas as driven up the price, therefor allowing commercial fishermen to make never before seen profits.

III. Consumers can easily be steered into trying other species of tuna (i.e. yellow fin), while the blue fin tuna’s population can recover.

For your Prewriting & Research Packet, you’ll need to find and cite six sources: three with location information and a note on how each one supports your argument, and three more with just the location information.

Document six sources below. You’ll write descriptions for your top three sources, but only list references for the rest. Be sure to use APA style.

WRITING TEMPLATE

Write 2 pages Term Paper – Virtual Museum Field Trip

Due 8 hour

Pack your passports as you go on a field trip assignment to the city of Rome! Once there, you will tour one of the city’s most famous museums – the Musei Capitolini.

To ‘be there’ we will use the google art project – here is the link to the museum: Capitoline Museum

at the landing page. click on the little google maps figure to the right and you will land in “museum view” which allows you to virtually tour certain parts of the museum

Once in ‘museum view’ you can click on the google figure inset on the right and it will take you to a floor plan for the museum

the gray rooms in the floor plan panel are the ‘virtual’ areas you can explore

Click on those to go directly to those parts (or you can just click the google earth arrows to get around in an ‘ambulatory’ way)

In the floor plan at the top there is a drop-down menu displaying the three levels of the museum

You can toggle between the different floors.

I want you to concentrate your tour on any of the ‘antiquities collections’ which are the types of art – mainly classical – that we have been looking at in class

ESSAY SYNOPSIS:

once you have gone on a tour, I want you to reflect on the overall experience.

You should research several works of ancient art that caught your eye

then choose an appropriate pair of works to compare and contrast

detail the features of those works in order to analyze and account for what they say

In other words, why are its features and forms significant? How do they compare in what they say/mean?

one thing you can to do to expand your discussion of this visit is to recognize the importance of this site (the Capitoline Hill) in Roman History (it’s the location of Rome’s mythical founding, and parts of the complex you see today were designed by none other than Michelangelo himself!)

Perhaps this will also allow you to compare the ancient forms you are looking at with more modern paradigms too.

You should have your report complete and emailed to me (by one person in the group – detailing all who participated
