Prior to beginning this discussion, review this week’s required readings and weekly lecture. OSHA has valuable guidelines for both the employer and employee. The purpose of OSHA is to provide, as far as possible, safe and healthful working conditions for U.S. workers. Under the law, both employees and employers have a role and responsibility. For this discussion, you will discuss the rights and responsibilities of the employee under OSHA.

In your initial post, take on the role you have been assigned to and examine how OSHA applies to you.

  • What are your rights and responsibilities?
  • How is it enforced?
  • What accommodations are available under OSHA?
  • What conditions must be met before an employee can refuse to work based on OSHA.

The purpose of this assignment is to analyze the effect of domestic
and international regulatory agencies and court systems on business
transactions and dispute resolution.

Read the following scenario:

You are the CEO of Bonner, a U.S.-based
farm equipment corporation. Bonner recently announced the release of an
innovative new tractor with technology based on a patented invention
developed by Bonner’s engineers. Bonner’s vice president, who is aware
of the upcoming product offering, bought 100,000 shares of Bonner stock

Prepare an infographic for the board (e.g.,

  • Compare the resolution of the patent dispute in a U.S. court with
    the resolution of the dispute using the World Intellectual Property
    Organization’s (WIPO) dispute resolution program. Search the internet to
    review WIPO’s dispute resolution program. (Information about WIPO’s
    dispute resolution program may be located on their website by searching
    the Internet for WIPO).
  • Assess the liability of Bonner’s vice president for purchasing the
    corporation’s stock prior to the announcement of the new tractor.
  • Assess whether Bonner has any legal or ethical duties to disclose the stock purchase, and if so, to whom?
  • Discuss risk management procedures Bonner can adopt to avoid or reduce situations like these from happening in the future.

Create a 350- to 525-word letter in response to the German farm equipment company in which you:

  • Explain why Bonner is the owner of the invention
  • Discuss the intellectual property rights owned by Bonner in the invention
  • Suggest a method of dispute resolution (e.g., arbitration,
    mediation, litigation, WIPO dispute resolution), why that method would
    be desirable for resolving the dispute, and how and where the dispute
    resolution should be held (United States, foreign country, online,
    etc.).

Introduction

Understandings of gender socialization. Childhood consumption reflects cultural constructions of femininity and masculinity and some have referred to this phenomenon as the “Cult of Pink and Blue”. However, this pattern is more than difference in color. The commodities of childhood including toys, games, and clothes reproduce gender difference and norms. This activity will allow you to examine empirical examples of how material culture is connected to the symbolic meanings of gender.

Directions

Chose an online store that sells children’s toys and clothes such as Target, Walmart, Amazon, Kohls, or Kmart. Browse the website and observe how the toys and clothes are constructing gender norms and roles. Then answer the following questions in 1-2 sentences each.

  • How are the toys/clothes different? Consider the type, color, what it is for, and what it represents.
  • How does the packaging reflect and reproduce commonly held ideas about genders?
  • Are there gender neutral toys or clothes? How do they differ?

In the situation that I would be the human resources director of a large regional bank and a female employee of the bank, a teller, reports that the assistant manager of the bank, a male employee, has harassed her and a couple other employees repeatedly over the past three months, I will start outlining the issue by following the below questions:

1. To describe the incident: What specifically happened? Narrate the alleged incident. According to Neuser (2005), “First, the employee should provide his narrative with as few interruptions as possible”. That will help to get the picture of the incident and start gathering facts.

2. To get the incident in date and time: When the situation happen?

3. To obtain staff member’s contact to interview and corroborate facts: Any other employee witnessed the alleged situation?

4. To classify the incident appropriately in order to address all nuances: You mentioned harassment, what actions do you consider as harassment? I would need to know what is her definition of harassment so I can better classify the incident. Probably the incident is not related to sexual harassment, but it is a bullying behavior. According to Neuser (2005), “Employee statements must be factual and based only on what the employee saw, heard, felt, and smelled.”
