The Bush Doctrine, Democratization, and Humanitarian Intervention by Andrew Fiala discusses the use of military force in pursuit of spreading democracy. Fiala uses the “just war” philosophy to critique the efficacy of the Bush Doctrine – examining different wars in history, such as World War II and the Iraq War, to analyze the use of military force as a means of international relations, in order to spread democracy. Lack of democracy is described as an idealistic form of human rights violation, which justifies the use of military force to ensure democracy is practiced. However, based on the outcome of recent wars, it seems although Democracy is not always the result, we are persuaded to believe that these war-torn countries are now better off. Fiala uses World War II as an example of false exaggeration of the outcomes of war, which in reality left the war-torn communities broken. Fiala states “Although neoconservatives can cite the post War success stories of Japan and Germany as examples of successful democratization, such an analysis must take into account the horrible destruction that was caused by this war… This historical judgment has been colored by an ideological tendency to ignore the excesses of the Second World War” (Fiala, 39). Painting this war in a way which made it seem as though there were few casualties of it was used as a tactic to justify the war.

We can see similarities to Fialas just war critique in book one of Orewells 1984, as Orwell touches on this facade of success and accomplishment in the face of a war torn, totalitarian community. Winston recalls a moment in the canteen when the telescreen begins to blast a message stating that “the battle for production” (Orwell, 58) was finally won, and that the standard of living has risen due to the great leadership of Big Brother. The telescreen goes on to list all of the accomplishments of the past year, “As compared, with last year there was more food, more clothes, more houses, more furniture… more everything except disease, crime, and insanity. Year by year and minute by minute, everybody and everything was whizzing rapidly upwards” (Orwell, 59). Winston is amazed that people are buying this information, as it is very obvious that the current state of the community does not mirror these statistics. Within the same thought, Winston recalls the actual state of the people, “How easy it was…if you did not look about you, to believe that the physical type set up by the Party as an ideal – tall muscular youths and deep bosomed maidens, blond haired, vital, sunburnt, carefree – existed and even predominated…So far as he could judge, the majority of the people in Airstrip One were small, dark, and ill favored” (Orwel, 60). Yet again, Winston touches on the reality of his world, and how it completely contrasts the imagined state based on statistics fed to him by proponents of Big Brother.

In comparing these two passages, a theme of imagined reality and actual reality are portrayed. Fialas neoconservatives are similar to proponents of Big Brother in that they are justifying their actions by over exaggerating the positive outcomes. They paint these destructive actions as morally obligatory, and as something that is for the betterment of all mankind. However, when we look at the reality of each situation – the tangible evidence – we can see that the state of reality is less than ideal. Big Brother makes use of false statistics and ultimate rule to keep its people in line, and in favor of the regime. Fiala uses examples of “just wars” to critique the popularity of the Bush Doctrine in justifying tragic actions, and discusses how painting the picture of ease and accomplishment can convince people that war is justifiable in the wake of ideological destruction. Both passages are working to exemplify the use of false (or misconstrued) statistics as a means of justifying war and control.

As noted in WA3, Kyle took your advice and decided not to spend the money to fight for his claim to “KFC.com” as the domain name for his new product line, Alabama’s Best Foods and reorganized the company as a LLC (limited liability company). Kyle, however, does want to continue the move of his business, Alabama Sunshine, to the next level of operations and he wants to complete the expansion by construct of a new store in Florala, AL. Recall that the property was owned by Sam; however, since Kyle’s business was so successful and people throughout Alabama and abutting States knew him and Alabama Sunshine, Kyle hired Angie to contact Sam, negotiate a price, and, if possible, buy Sam’s property, Kyle instructed Angie to not tell Sam that she was working for Kyle. Unfortunately, Angie realized that Sam’s property was an exceptionally good deal and bought the property for herself, not Kyle as agreed. Kyle has gotten over his anger and wants to move on with the construction of the new building on Greenacre (the Angie/Sam parcel of land).

Angie had acquired Greenacre in fee simple absolute and proposes to convey Greenacre to Kyle with a right of reverter (reversionary interest) as the location for Kyle’s new store. The proposed conveyance would be a defeasible fee (fee simple defeasible) with the condition that, should Kyle fail to construct and open his store on Greenacre within 24 months or should Kyle cease to use Greenacre as a site for his store in the future, then Greenacre would revert back to Angie or her heirs. Angie also mentions that she does not want to transfer mineral rights to Kyle.

All this sounds pretty complicated to Kyle and he is growing nervous about this deal. His knowledge is in growing, processing, and marketing produce, not real estate transactions and land transfers. Knowing that you are (successfully) completing BL 240 and have studied land-use control and real property, Kyle turns to you for counsel. He is also concerned about any other problems that he should consider in this transaction or relating to the construction of the new business location. What are the legal issues and how would you advise Kyle? Kyle also mentions that a customer of United Nutrition Associates (UNA—recall WA2) is complaining that his holiday pack did not provide the health benefits that she would expect from organically grown produce. The family has filed a complaint with the federal government and is now threatening a lawsuit. Kyle wants to know what the legal issues are and how he should respond.

TEACHERS NOTE

As you get ready to write and organize your Outline for the Final Paper, I wanted to point out a couple of things about the required components for the outline.

You need to provide a:

  • A description of a business situation that presents a legal and ethical issue.
  • A description of at least two ethical theories under which the situation will be analyzed. Ethical theories: see Chapter 4.1. These are established, academic theories on ethics that need to be discussed (not ones you have created – I say this because I have had students do this.)
  • An explanation of the three specific areas of law under which the situation will be analyzed.

Descriptions and explanations are not just listing theories, laws and even a business topic. A description and/or explanation will need to be more than just lists. Keep this in mind!

If you just list but don’t provide a brief description/explanation on the topics that you will be discussing, it will affect your grade. The description/explanation lets me know where you are in your research and preparation for your Final Paper, and will demonstrate that you understand the information and are applying it to the chosen Final Paper business topic.

Also, you are required to have “a reference page that includes at least 10 scholarly sources” – these need to be cited correctly. Review any feedback you have received in your Week 1 – Week 3 papers for assistance, along with one of my first announcements in the class (Helpful Hints) and the Writing Center. This is a significant portion of your grade for the Outline.

I know many of you, and hopefully all of you, are thinking about and/or working on the Outline for your Final Paper. Excuse the wordiness of this email/message, but I want to give you some guidance on your topic!
Topic

When considering a topic, please keep in mind that you need to write an in-depth paper on a legal/ethical issue that can or has occurred in a past, present or future work environment or a current event that affects a work environment. I suggest that you pick a topic that interests you and one that you can find enough research to support information.

This could be any number of topics ranging from environmental pollution from a business, discrimination (age, racial, sex, national origin or any other type of discrimination), issues with Family and Medical Leave Act, whistleblowing, specific situations that have occurred in a work place, LGBT rights in the military, HIPAA, preventing medical malpractice within a health care facility, workplace privacy, the requirement of drug screening in the workplace, and workplace diversity; these are topics that can be appropriate, to name just a few.

Some students like to look at educational issues, which could involve issues with a college accepting students who will be unable to pay for student loans, affirmative action, union negotiations, the requirement for teachers to belong in unions, college recruitment of students that may border on unethical actions (to maintain recruitment quotas), or standardized testing in elementary schools (and how it affects the business end of running a school).

There is obviously a wide range of legal issues that affect the business world. Review the textbook and the Instructor Guidance pages as those can all lead to a solid topic.

Just make sure your subject is about an issue that affects a work environment. I had someone right about the First Amendment in a church, but never connected it to a work environment – it did not meet the requirements. I also had someone write about child obesity – but once again, it was not about a work environment.

Avoid doing this: Students have tried to write about all work place discrimination that can occur, in one paper, and that was not an in-depth paper but rather a cursory discussion on all of the types of discrimination. Pick ONE type of discrimination and focus on that – do not try to do all or even several types of discrimination.

If you choose to address a current event, make it a current event. This should be something that has occurred in the past one to two years. I have had students provide a discussion on the history of the tobacco industry, the Enron scandal (2001), Martha Stewart’s arrest (in 2004) and yes, even the liability of the owners of the Titanic (really not current). These were not successful current event topics.

Do not write a general paper on general ethics, or how business ethics are good, or a paper trying to cover different ethical examples in business, government and society, without a main topic. This will not be specific or in-depth enough.

Keeping the following components in mind, make sure you can satisfy these requirements on your Final Paper within your chosen topic.

Final Paper Components
Within your topic, you will need to provide:
1. A description of the business situation
2. The identification and discussion of three (3) applicable laws, areas of law, and/or sections of the U.S. Constitution that apply to the business situation
3. A discussion on at least two (2) different ethical theories that will support at least two different outcomes
4. The identification and discussion as to which ethical theory provides the best outcome for your chosen business situation, and why
5. Recommendation to reduce liability exposure and improve ethical climate or the overall ethics of the situation

Will your topic be able to support a Final Paper that is 11-15 pages in length (excluding title and Reference pages) and will have at least 10 scholarly sources to support the topic (scholarly references, not encyclopedias, dictionaries or Wikipedia)?

Keep these requirements in mind, too, when choosing your topic.
