can you help with my question?

  1. How do you believe the U.S. Supreme Court should rule—for or against Kibbe? Why? Use concepts from the text to support your response and opinions.

On a very cold night in Rochester, New York, Barry Kibbe and a friend met Stafford at a bar. Stafford had been drinking so heavily that the bartender refused to serve him more alcohol, so Kibbe offered to take him barhopping elsewhere. They visited other bars, and at about 9:30 p.m., Kibbe and his friend drove Stafford to a remote point on a highway and demanded his money. They also forced Stafford to lower his trousers and remove his boots to show he had no money hidden. Stafford was then abandoned on the highway, in the cold. A half-hour later, a man driving his truck down the highway saw Stafford standing in the highway, waving his arms for him to stop. The driver saw Stafford too late, and he was struck and killed. Even though the driver of the truck killed Stafford, Kibbe was arrested and charged with robbery and second-degree murder, raising a challenging question of causation—a necessary element in holding someone criminally responsible for a death.

State Court Actions: In State v. Kibbe, Kibbe was tried and convicted of robbery and murder in the second degree. At trial, the judge did not instruct the jury on the subject of causation (e.g., that the government had to prove Kibbe had actually caused Stafford’s death). On appeal to New York’s appeals court, in Kibbe v. Henderson, Kibbe argued that the judge should have given the jury such an instruction so that they would have to determine whether the state had proved this element beyond a reasonable doubt, but the appellate court affirmed his conviction. Then, on appeal to New York’s supreme court, the conviction was also affirmed. Both courts found that the judge did not err in failing to instruct the jury about causation.

Federal Court Actions: Having exhausted all possible state remedies, Kibbe then sought redress in the federal court, filing a writ of habeas corpus with the U.S. district court having jurisdiction and arguing that the trial judge had violated his due process rights by not giving the jury instructions regarding causation. The district court denied the habeas petition, saying that no constitutional question had been raised.

Next, Kibbe appealed to the Second U.S. Circuit Court of Appeals, making the same argument. This court, however, reversed his conviction, saying that Kibbe had been deprived of due process because of the trial judge’s failure to instruct the jury on causation. Next, the government appealed, this time to the U.S. Supreme Court; in Henderson v. Kibbe, the Supreme Court, issuing a writ of certiorari to the lower court, decided to hear the case.

The purpose of this essay will be
to demonstrate to me that you can argue effectively about literature. You
should have a
clear thesis statement
that you then support with specific evidence throughout the rest of your essay.
Your evidence will come from the text itself and from secondary sources as
well.
This essay is not a plot summary, response paper, book report, or
explication. Instead, it is a persuasive analysis in which you enlighten the
work of literature you are writing about.

You should assume that your reader
is familiar with the literature you are discussing and address that reader
accordingly.

The specific topic concerning literature
is up to you, and the approach you use in your analysis will also be up to you.
You are welcome to employ whatever analytical tools seem appropriate to your
topic and to your interests. Your essay must deal with literature we are
studying in this course. Look at the list I have given under “Course Paper
texts”.  You may discuss one or two works
of literature but no more than two works. For example, you can write a
comparative analysis of the female characters in “The Woman’s Swimming Pool”
and “In Camera,” OR you can do an in-depth analysis on the role of desire in Mo
Yan’s “The Old Gun”
(it is up to
you!).

You must have at least FOUR secondary sources. NO BLOCK
QUOTATIONS (any quote that extends beyond 4 typed lines). These sources must be
scholarly. Remember, you are in college and your writing must reflect scholarly
thinking and presentation. This is not your weekly discussion board responses.
It must reflect your mastery of ENG 1101/1102.

Papers should be double spaced, with 1” margin on the left
and 1.5” margin on the right.  Please use
12-point Times New Roman.  Cite your sources according to MLA. You
should have a minimum of FOUR outside
sources.  Do not use Internet sources
unless the exact same source exists in a printed form and merely happens to be
on-line in a full text version.  Papers
will be graded on the originality of argument, use and integration of textual
evidence, development of detail, and mechanics of writing.

Word
Limit:

MINIMUM of 8-9 double-spaced pages (9th page will be Works Cited)

For this case analysis, you should prepare a written analysis of 3 to 5 pages that uses the text and other credible sources as appropriate. Your paper should have 1″ margins, be double spaced, and use APA formats for

  • topic and subtopic headings
  • citations
  • references

Your case must minimally address the following issues / questions:

Nurse educator

Advanced registered nursing graduates are entering the profession at dynamic time when roles and scope of practice are shifting based on developments in legislation and policy in response to the evolving needs of the health care system. Professional nursing organizations play an important role in making sure the perspectives of advanced registered nurses are heard, and in supporting nurse specialties in their efforts to expand their scope of practice and their full participation throughout the health care system.

For this assignment, you will conduct research on the current scope of practice for your specialty as (MS Nurse Educator) and efforts that are being made to expand that scope and the role of the advanced nurse in positively influencing the health care system. Write a 1,500-word paper that includes the following:

  1. A discussion of the scope of your future role as an advanced registered nurse, including any regulatory, certification, or accreditation agencies that define that scope.
  2. A discussion of three professional nursing organizations that you think are most influential in advancing the scope and influence of advanced nursing. Of these organizations, evaluate the one that you would most like to join. How do its goals and mission fit in with your worldview and philosophy of care? How might membership in this organization improve your practice?
  3. A discussion of a controversial or evolving issue that is most likely to affect your scope of practice or role in the next few years. How do you think this issue could influence the profession and other stakeholders, and why does it matters to the advanced registered nurse?

You are required to cite 10 sources to complete this assignment. Sources must be published within the last 5 years and appropriate for the assignment criteria and nursing content.

Prepare this assignment according to the guidelines found in the APA Style Guide, No PLAGIARISM.

Qualitative and Quantitative Research Analysis, law homework help

Qualitative and Quantitative Research Analysis

Below is an example of a mixed methods approach to considering one element of the post-Katrina response.

Problem statement: This researcher is interested in studying posttraumatic stress disorder (PTSD) in soldiers who deployed to the area from the 82nd Airborne Division, as compared to experiences they had in combat operations prior to Hurricane Katrina. The researcher wants to examine whether they experienced greater trauma helping Americans in trouble than they do on distant battlefields.

The researcher intends to use survey instruments with carefully crafted questions, the answers of which she can numerically collate and process. After all of the data is processed, she intends to follow up with selected soldiers based on their answers by speaking to them personally and conducting conversational interviews.

Primary Task Response: Within the Discussion Board area, write 400–600 words that respond to the following questions with your thoughts, ideas, and comments. This will be the foundation for future discussions by your classmates. Be substantive and clear, and use examples to reinforce your ideas:

  • Critically evaluate the problem statement. Is this a problem that can be undertaken or answered with the instruments she has listed she intends to use? Why or why not?
  • What other techniques or instruments do you recommend she add to her intended tools? Why?
  • Do you feel there is information missing?
    • If so, what information do you think is necessary? Why?
    • If not, how is the information sufficient? Explain.
  • What do you think are the assumptions this researcher seems to be employing? Explain.
    • Do you believe the assumptions are strong or weak? Explain your answer.
  • What do you think are some of the challenges or limitations this researcher might encounter during her study? Explain.
    • What might be some ways she can overcome these?
