Legal Approaches to Counterterrorism

You are a program analyst with the Department of Homeland Security, assigned to DHS Headquarters. You work in the Office of the Secretary, Office for Civil Rights and Civil Liberties (CRCL). You are responsible for developing guidance and policy to support civil rights compliance and providing recommendations to address complex civil rights issues. You also provide a full range of advice, training, support, outreach, and complaint investigation related to civil rights concerns connected with the access to DHS-supported or conducted programs by individuals with limited English proficiency, or to the U.S. Immigration and Customs Enforcement (ICE) 287(g) program, along with other federally conducted and supported activities.

Your superior has assigned you an unusual task in anticipation of an in-house training and development program. This office is clearly focused on civil rights, but you have been asked to play devil’s advocate for a day. Your office deals with complaints of civil rights violations, investigating complaints brought by individuals with limited English proficiency. Your task is to present a memo that will be distributed to everyone at the training as required reading.

Your memo will be on the topic of: How might the DHS look and function if civil rights and civil liberties were not valued?

Your answer to the following question can assist you in developing your memo: If the DHS employed a true public-order approach to combating terrorism, what would they do differently right now?

Assignment Guidelines

  • Use your course materials, the library, and relevant Internet research options to research what the Office of the Secretary, Office for Civil Rights and Civil Liberties (CRCL) does, and how its operations affect homeland security policy decisions.
  • Address the following in 750–1,000 words:
    • What functions does the Office of the Secretary, Office for Civil Rights and Civil Liberties (CRCL) perform? Explain.
      • This is the starting point for this assignment. Once you understand what the office does, then you can start to work on identifying how the DHS might change its function if civil rights and civil liberties were no longer a requirement.
    • Do the activities and operations of the Office of the Secretary, Office for Civil Rights and Civil Liberties (CRCL) impact homeland security policy decisions? Why or why not? Explain in detail.
    • How might the DHS change its function if civil rights and civil liberties were no longer a requirement? Explain in detail.
  • Be sure to reference all sources using APA style.

legal Assignment 5

Richard, a resident of Raleigh, North Carolina, files a lawsuit
against Brad, who lives in Durham, North Carolina. Richard files his action in
North Carolina state trial court. His complaint reads, in whole:

“The Plaintiff alleges:
1. On or about April 5, 2016, Brad walked into Richard’s office
and there illegally and feloniously assaulted and battered Richard, thereby
causing to Richard great pain and suffering.
2. On or about April 5, 2016, Brad caused Richard to be unlawfully
confined in a bound area, causing great physical and emotional suffering on the
part of Richard.
3. As a proximate result of Brad’s wrongful and unlawful conduct,
Richard suffered physical and emotional injuries worth the sum of
$200,000.
Wherefore, Plaintiff demands that Brad be forced to pay to Richard
the sum of $200,000 in compensatory damages, $1,000,000 in punitive damages and
any other relief that the court deems just and proper.”

The complaint is properly captioned, signed and served on
Brad.

1) Brad moves to dismiss the action on the ground that the
complaint was not specific enough and therefore must be dismissed because it
fails to state a claim upon which relief can be granted. Under North Carolina
case law, is Brad correct? This part of the assignment should be answered in
essay/ IRAC form.

2) Do you see anything else that is missing from the complaint
that makes it defective? If so, what? (and yes, you can infer from the question
that there is something else that makes this complaint defective beside the
issue addressed in question #1.) This part of the assignment can be answered in
as little as one sentence.

Just these questions

Step 1 Review the scenario.

The senior attorney on the second floor of the office building had been a big help in advising attorney Owen Mason, based on his years of experience as a lawyer. He rarely tried any cases, at least not in the past 10 years. He approached Mason to personally request his paralegal’s help with a case that had been filed in federal court. He had just received a discovery request involving Product Guild Limited (PGL), one of his biggest international clients. PGL was a paperless organization that stored everything electronically. There was a request for all the e-mails from the client for the past two years and all the corporate correspondence and a time deadline imposed by the rules of court. The senior attorney asked Mason if you could work for him as a part-time, independent paralegal to help handle this request. Mason agreed and asked you to begin working on this. (Note that this is similar for what you did for the previous assignment BUT should be information on how to REPLY to a discovery request. This is not a document to be served on the opposing counsel or filed with the court. Rather this is a memo to include information to provide to the senior attorney on how to handle the request.)

Step 2 Refer to the FRCP as necessary including the most recent amendments.

Use an Internet search engine to locate the Federal Rules of Civil Procedure (FRCP). See rules 26, 33, 34 and 37 specifically regarding discovery. You have probably completed this research already for the previous assignment.

Step 3 Write a memo to provide information on how to respond to the discovery request.

Write a memo to the senior attorney to provide him with information on how to respond to the discovery request described in the scenario in Step 1. Include the information that the legal team will need to gather for the requested documents and what else they will need to know in handling the discovery request from the opposing team. Answer the following questions in your memo based on the information provided in the scenario:

  • Which documents are required by the Federal Rules of Civil Procedure to be provided to the opposing legal team under this request?
  • How will the requested documents be gathered?
  • What file format(s) will be used?
  • How will confidential and privileged information be protected from disclosure? Are there any ethical considerations that should be addressed while reviewing or producing the information?

Exam #1 Questions

Defend or Refute one of the following statements:

  1. Sacred texts (like the Bible, the Vedas, etc.) are completely useless as sources of historical documentation.
  1. Any population of humans that began farming was destined to create a successful empire.

(Hint: This essay should also discuss how such a population would progress from basic agriculture to empire).

  1. The sciences of genetics, linguistics, geology, and biology provide a complete and incontrovertible picture of humanity’s pre-literate past.

(Hint: This essay should specify what information, or at least what type of information, each of these sciences does illuminate, as well as with what types of information they are less helpful).

Vice President of Operations Part 3

Assignment 3: Vice President of Operations, Part 3

  3. Analyze the key concepts related to capacity planning and facility location for the new location.
  4. Examine the current work system design, and determine your organization’s selected feasibility in the job design (i.e., technical, economic, behavioral). Assess key elements of the rationale in the work design competitive advantage.
  5. Using the method analysis described in the textbook, defend the new change implementation process and the rationale for the change of method.
  6. Develop a diagram showing network planning techniques, in which you use the program evaluation and review technique (PERT) and the critical path method (CPM).
  7. Use at least three (3) quality academic resources in this assignment. Note: Wikipedia and other Websites do not quality as academic resources.

Your assignment must follow these formatting requirements:

  • Include a cover page containing the title of the assignment, the student’s name, the professor’s name, the course title, and the date. The cover page and the reference page are not included in the required assignment page length.
  • Include corresponding speaker notes for each slide included in the presentation.

The specific course learning outcomes associated with this assignment are:

  • Apply descriptive statistics to measure quality characteristics.
  • Analyze the key concepts related to capacity planning and facility location.
  • Examine the key elements of work system design, the project life cycle, and project management.
  • Use technology and information resources to research issues in operations management.
  • Write clearly and concisely about operations management using proper writing mechanics.

A minimum of 100 words in response to the questions and a 100-word minimum critical response to 1 classmate’s post

To further your thinking about the assigned readings regarding the criminal trial and sentencing (Chapter 9), a discussion question is provided below. First, compose a minimum of 100 words in response to the questions. Second, save the work to your hard drive, and then, post your response here in Canvas. Next, read the responses provided by your classmates and compose a 100-word minimum critical response to 1 classmate’s post. (I will provide you one of the classmates’ post to respond to after you deliver my answer because the classmates’ responses will be visable rightafter I post my answer)

Carla is a 36-year-old white female convicted of killing her husband of 12 years, John, a wealthy and prominent attorney. The police report shows that to inherit his substantial trust fund, Carla gave her husband a large dose of a sleeping sedative, and, when he felt uncomfortable and dizzy, offered to take him to the emergency room at the local hospital. After he passed out in the car, she slid the comatose man into the driver’s seat and then rolled the vehicle down an embankment. After watching the car burst into flames, she walked to her own car, which she had hidden earlier, and drove home. When police came to report the accident, she told the officers that John had gone to get some groceries and she was wondering why he had taken so long. At first she expressed shock over his death and burst into tears. Later, forensic evidence and an eyewitness to the event helped investigators unravel her plot.

This is Carla’s first conviction. She is a highly educated woman with a degree in French Literature from an Ivy League university. She comes from a loving and devoted family. Her parents and sisters, though in shock, are willing to stand beside her. She has two young children who are currently living with relatives; they seem devoted to their mother. She has done charitable work and is well-liked. She has no prior history of violence, mental instability, or the like. Psychiatric reports show that she is unlikely to commit further crimes.

At the sentencing hearing, Carla is filled with remorse and states that her greed overcame her reasoning. She is currently on suicide watch at the county jail because she has told her counselor that she “does not deserve to live;” her anguish seems genuine.

As a member of the jury during the capital sentencing stage, you hold Carla’s fate in your hands. You can recommend death, life in prison, a prison sentence, or even probation. State law requires that each jury member provide a written document stating the reasons for his or her sentencing decision. What are the reasons for your decision?

Finally, if you pull additional information from a source (internet, book, article, journal article) to develop your response, please be sure to cite it appropriately in APA format. Below is an example to follow for a journal article. This includes the authors’ names, year of publication, title of the article, the name of the journal in italics, the volume number of the journal in italics, and the issue number in parentheses, followed by the page number range:

discussion after reading Woman at Point Zero

1. Select 1 passage from Woman at Point Zero. (The words passage and quotation are used interchangeably and mean the same thing. You may also piece together multiple passages using ellipses (…) in between. Be sure to include the page number(s) after the passage, like this (17-18).

2. Write a short summary of the passage (1-2 sentences). This is just to get the summary out of your system and to be able to focus on an analysis.
3. Analyze the passage you have chosen (3-4 sentences). What does is show you as a reader? Can you apply the theoretical lenses to the passage? What does that reveal about the passage? What is your interpretation of the passage? Remember to avoid summarizing the passage Remember to avoid making overgeneralizations based on the text.

4. See sample below.

Your post should look something like this: (Note: See the link “passage analysis” under the heading “Guidelines for Writing about Literature” in the “Course Resources” section of the course site.)

Passage: “Nan said to Tess, but projecting for the benefit of the front, ‘Truly, are we so superior as we think? I wonder little. When we first moved in at the mine, we did something at the house so stupid am still in pain. There were two pawpaw trees growing side by side by the house, one thriving with nice big pawpaws on it and the other sick-looking and leaf-less – dead looking. Well, we thought it was plain what we should do: take down the dead tree. So we hauled and pushed on the trunk of the poor tree and strained and pulled it over – uprooted it, Gareth and myself. It was his idea: we must just straight off do this, get it over. Then, with the crash, the servants come out. They had funny looks on. Dineo said, so quietly, ‘Oh, Mma, you have killed the male.’ We didn’t understand. It seems the pawpaw grow in pairs, couples, male and female. The male tree looks like a phallus – no foliage to it, really. The female needs the male in order to bear. They take years to reach the heights ours had. Then the female died. The staff had been eating pawpaws from our tree for years. It was a humiliation” (Rush 21).

Summary: Nan is explaining to Tess how she and Gareth dug up a tree that looked like it was dead, but that they learned from the natives that they were all wrong about their interpretation of the tree. It looked dead but the other tree needed it for its survival.

Analysis: The pawpaw trees function as a symbol within the text. They symbolize the hierarchic relationship between the men and the women in the text as well as the hierarchic relationship between the whites and the blacks in the text. When Rush writes that they “uprooted” the tree, it brings to mind the appropriation of colonies and cultural upheaval.

answer to the question of whether project managers would make good Scrum Masters

In Module 7, the matter of leading agile teams is discussed generically in terms of the concept of servant-leadership. It’s also covered specifically with regard to how the concept is exemplified in the Scrum Master role. Any organization which fully implements agile and creates self-managed teams has to deal with the matter of finding people to properly lead those agile teams. If Scrum is to be used, someone must successfully fulfill the role of Scrum Master.

The module content describes the Scrum Master role in detail and notes its key aspects. It raises the question of what kind of resources in an organization should be appointed as Scrum Masters. It highlights multiple options, including that of the project manager.

For this project, you will write a two to four page paper using the assignment template which will provide YOUR answer to the question of whether project managers would make good Scrum Masters. Remember, the role includes serving the product owner, the development team and the sponsoring organization. It requires a great deal of soft skills and most of all, leadership. You should be sure to address the key points and questions related to this topic expressed in the lesson, however, you are free to offer additional points based on your own investigation or experience.

You may relate any similar situations which you may have encountered in your own career, any previous course you’ve taken, or even integrate sources selected from a trade journal, newspaper or magazine article, book or web-based source. As always, you should describe assumptions and any background information about such situations in your paper. If you do reference a third-party source, please be sure to list its name and provide a link to it if it is available on the Internet or in the Bobst Library’s digital archives.

As was the case with the first project for this course, there is no single right answer to this question. Your grade will be based on the depth and clarity of your analysis of the question posed in the assignment as well as how well you express your own opinion and justify it.
