Literature Analysis Instructions

The student will write a 10–12-page Literature Analysis on specific problem in criminal justice. It should not be a descriptive paper but one that critically examines the problems and the competing solutions. The student should make an argument if need be. The paper must utilize at least 12 significant, scholarly resources that are significant to the topic (current, relevant, credible, and each carries its weight) with a clear and meaningful connection between all the resources. The paper must properly follow current APA style. Detailed instructions can be found in Blackboard. If a student is struggling with current APA format, he/she may refer to the Additional Information folder for help.Organize and format your paper according to APA style.If you need more help understanding how to analyze scholastic literature consult the corresponding section in your APA manual.

Include the following elements in your paper:

• Title page including a running head
• Abstract and key words
• Body

The body of the paper consists of all of the questions a person would ask if you mentioned the hypothesis to them. What is it I am researching? What is the current problem? What is the solution? What do my critics say about the problem and my solution? What does the literature say about the problem and my solution? What gaps in the literature will my solution address? If successful, what are the implications of my research? And a conclusion. Conclusion (Make sure you reflect back upon your thesis statement and make adjustments as needed.)

Identify a conflict between two groups, and obtain approval from your instructor. Please see attachment on topic

Write a 700- to 1,050-word paper in which you create a program to improve the relationship between two groups. Examples include between police and a community, managers and subordinates, the city council committee and a special interest group, and unions and management. Be specific in identifying what community, company, or organization you are writing about.

Be sure to use at least two references in your individual assignment.

Nature of the Conflict

• Describe the context of the conflict. What kind of community or organization is this? Who are the stakeholders in the outcome of the conflict?
• Identify the overt and covert issues presenting both sides.
• Describe the effect the conflict has on the organization within which it exists and, if applicable, the surrounding community.
• Identify attribution errors and how they will be addressed in the program.
• Analyze the dynamics within each group and between groups. Who are the leaders? Does anyone stall or undermine the group? Is there a relationship between two subgroups?

Program Design

• Apply the elements of conflict resolution.
• Describe the central strategy you will use to resolve or diminish the conflict.
• Provide at least one reference supporting the use of such a strategy.
• Include a program component that employs social media.
• Explain how you will address attribution errors between the groups.
• Identify the elements of persuasion you will use in your program.

Create a 15- to 20-minute presentation that you would give to sell your program to the company or organization where the conflict exists. The presentation should be accompanied by 10 Microsoft^® PowerPoint^® slides with speaker notes that include the following:

• The goals of the program
• The logistics of the program (schedule, location, and so on)
• The content of the program (any worksheets, activities, or events)

Cite at least 4 references in your presentation, including the reference that demonstrates research support of your program strategy.

Format any citations in your presentation according to APA guidelines.

Assignment: Use the discussion guide and answer the questions concerning the varied viewpoints in Geri’s story.

Handout 5: Geri’s Story
Geri is a four-year-old girl who was enrolled in Head Start for the first time a month ago. She lives with her mother and her older brother. Her mother works part-time on a late-night shift while the children stay with extended family members. Geri is very active and she likes to play outdoors. Her behavior is hard to predict. She has bitten other children a number of times. And just last week, while she was playing with dough, she hit the child next to her in the face with a garlic press. Then she threw herself down on the floor and began sobbing. Geri will not talk and no one knows why. She is still wearing diapers.

Consider the following scenario:

Bob paid $800 for the right to buy a specific 10 Acres of land, within five years, from Margaret. The price was set at $50,000. The option was in writing, was legal and valid, and Bob has now legally exercised the option by tendering the price, as required by the option. Margaret refuses to sign and deliver the deed, so is in breach.

The original purpose of the purchase, as stated in the option, was to use it for a mini storage facility. Bob did not promise to use it only for that purpose. Bob insists on getting specific performance, not money damages.

The property is now likely much more valuable, worth over $200,000, due to interest from commercial developers for a store. Margaret claims that Bob had some advance knowledge that this project was possible, and did not disclose this to her when he negotiated the price.

Margaret is willing to pay Bob $35,800 in damages rather than grant him specific performance. In the alternative, she is willing to substitute a different 10 Acre parcel of land. It is suitable for a mini storage facility and is worth about $85,000.

The parties agreed to a mediation process, involving meeting with a neutral person who assists them in negotiating. Explain Bob’s position to Margaret and the mediator and argue for it. Then, explain Margaret’s position and argue for it.

Here are some questions to help you.  

-Remember that both parities are in mediation.  They are allowed to negotiate remedies that are more creative than those a judge would be able to impose.

-Is there unfairness in the contract that might allow the contract to be thrown out or modified?  Is the contract unconscionable?  If Bob’s failure to notify Margaret about the possible increase in value any excuse for her to fail to perform?

-What forms of discharge might be applicable, such as novation, accord and satisfaction, or simply fulfilling the contract by performance.

-What legal and equitable remedies are available and could be applied other than specific performance, such as compensatory, damages, or rescission?  What is the “benefit of the bargain” for Bob?  If the contract is completed and he is able to actually sell the premises for current value, what he net?
