Criminal liability is dependent on the concurrence of a criminal mental state with the commission of a criminal act; thus, the attempt to commit a criminal act may be sufficient. Therefore, it can be a fine line as to whether one incident may be the subject of criminal liability while the other is not. Concurrence requires that a criminal act occur at the same time the actor possessed the required criminal mental state. To convict a defendant of a given crime, prosecutors must prove to a judge or jury that all the statutory elements of a crime are present. The burden of proof is beyond a reasonable doubt. If even one statutory element of an offense cannot be established beyond a reasonable doubt, it is concluded that criminal liability will not have been demonstrated, and the defendant will be found not guilty.

Option #1: Phase 1 of IT Infrastructure for a Small Firm

In
Option #1, you have been hired as an IT expert by a small firm to set
up an office for 20 staff members, half of whom will work with desktop
computers and the remaining with laptop computers using wireless

A significant ethical issue confronting a professional field will be determined by the student. It is expected that students will choose a field in which they expect to be involved upon graduation. Describe the issue in “lay-person” terms and provide definitions for any technical terminology being used. This should be written as if it were to be published in a venue being read by practitioners in the field but also the interested public.

Unit 8, Assignment 2: Case Analysis

Scenario:

Greg Allen is an employee, shareholder, director and the president
of Greg Allen Construction Corp. In 1996, Daniel and Sondra Estelle hired
Allen’s firm to renovate a home they owned in Ladoga, Indiana. To finance the
cost, they obtained a line of credit from Banc One, Indiana, which required
periodic inspections to disburse funds. Allen was on the job every day and
supervised all of the work.

He designed all of the structural changes, including a floor
system for the bedroom over the living room, the floor system of the living
room, and the stairway to the second floor. He did all of the electrical,
plumbing, and carpentry work and installed all of the windows. He did most of
the drywall taping and finishing and most of the painting.

The Estelles found much of this work to be unacceptable, and the
bank’s inspector agreed that it was of poor quality.

When Allen failed to act on the Estelle’s complaints, they filed a
suit in an Indiana State court against Allen Construction Corporation and Allen
personally, alleging in part that his individual work on the project was
negligent. Can both Allen and his corporation be held liable for this tort?
Explain.

Paper Submissions: There are two types of APA manuscripts: copy
manuscripts (those submitted for publication) and final manuscripts (those not
submitted for publication). Copy manuscripts are much more formal and may
contain multiple sections. Specifically, they will have an abstract (a
one-paragraph summary of the paper). The papers you produce for most Kaplan University classes will be final manuscripts. Unlike
copy manuscripts, final manuscripts do not, unless specifically required by an
instructor, require an abstract.

They do include:

A title page;

The paper itself (the “discussion”) and

A references page.

Formatting the discussion, or body, of the paper, is also quite
straightforward. APA final manuscripts are generally double-spaced (unless your
instructor requests otherwise). The running head appears in the upper left
corner of each page, before the page number (on the upper right hand corner).
The full title also appears, but only on the first page of the body of the
paper. For subsequent pages, the running head is the only “title” present.

New paragraphs should be indented (which is the default setting
for the Tab key) and there should not be an extra blank line between
paragraphs.

The last thing required is the references page. This page, like
the others, has the running head and page number in the upper-right hand corner.
Sources should be alphabetized by the author’s last name (or, for sources
without authors, by the first letter in the title) and the second line of each
source should be indented a half inch (the first line is not indented).

Here are a few additional formatting standards to keep in
mind:

  • Use standard margins: 1″ on all
    sides.
  • Use standard 12-point font size.
  • Use standard double-spacing: average of
    22 lines per page, and between 20 and 24 lines per page.
  • Use left-aligned text. Do not
    right-justify.
  • There should be no spaces between
    paragraphs within the paper.
  • When citing a quote of more than four
    lines, you should indent the entire quoted passage 10 spaces from the left
    margin. It is not necessary to indent these block quotes from the right margin.
    Continue with the usual double-spacing, and give the usual acknowledgements at
    the end of the quote. Block quotes do not require quotation
    marks.

Annotated Bibliography

Any further questions can be answered in this week’s Online+ portion of
the module, which will focus on how to create an annotated
bibliography.

With your proposal and any other research that you conduct you will
need to find resources to support your topic and then reference them in
order to give credit where credit is due. Annotated bibliographies are
typically used for academic research papers, but they can also be useful
tools for professional reports and proposals. In an annotated
bibliography, each reference includes an additional summary that
describes the content and explains why the source is useful. In your
summary explain why the source is included in the bibliography. As you
summarize each source, make sure you identify the main idea that will be
highlighted. Construct your summary around the meaning and value of
each source and establish a connection of the source to the proposal.
You must distinguish credible and accurate types of materials to support
the main concept of the proposal and recognize the context of your
sources.

For your annotated bibliography, include at least five sources, of
which two must be from scholarly journals. To locate your sources, you
will need to utilize effective search tools within the databases to
distinguish relevant academic and professional sources. Use the
databases in the library to locate the scholarly resources. The
databases can be found in the Library Resources tab.

Executive Summary

With your outline completed and a general idea of what your proposal
will look like, take time now to develop a short Executive Summary. The
executive summary is a one-page summary of what to expect in your paper
highlighting the main points of your proposal. You should use the
executive summary as a tool to get the reader intrigued so they want to
read your proposal to get more information. To engage the reader,
identify the purpose and use appropriate tone and usage for the
audience. Consider addressing the situation and your audience’s views
fairly and respectfully.

As you summarize, be sure to convey the understanding and scope of
the proposal. Give a thorough explanation of the proposal, and highlight
relevant research to support the main idea.

Your executive summary should be written as a professional document and should include these headings:

  • Purpose
  • Problem
  • Solution or Plan mentioning your research
  • Conclusion
After you finish your Executive Summary, it may be necessary for you to
revise it later when you complete and submit your final draft.

Based on your consulting company’s initial work in discovering the business needs of Mid-Century Modern Décor Unlimited (MCMDU)(see attachment below), you now have the following additional information about your client company’s processes that will need to be supported by the planned inventory information system:

Addition of new item to inventory system: the marketing/sales staff, in cooperation with the manufacturing staff, transmits the basic information on new products to be added to inventory management on a paper form brought to the inventory management office. This form must contain approval signatures of the Vice President for Operations and the Vice President for Sales. Upon receipt of a correct form (as determined by the Inventory Management staff), the inventory information for the new item is added to the appropriate Microsoft Excel 2010 workbook(s).
  2. Recurring inventory report: the inventory is reported on a monthly basis in printed form and distributed through interoffice mail to the owner, vice presidents, and managers of the manufacturing and marketing/sales departments.
  3. Ad-hoc inventory reports: an ad-hoc report on one or more inventory items may be requested by the owner, vice presidents, and managers of the manufacturing and marketing/sales departments. These requests must be created on a “Special Report Request” paper form brought to the inventory management office. The inventory management staff attempts to produce these reports within two business days of the time of the request.
  4. The inventory management staff will also create an ad-hoc report in printed form upon phone request from either the owner or the company vice presidents. There is not a special form for this request: the inventory management will jot the specifications for the needed report down on paper when called by these individuals with a request. The inventory management staff attempts to produce these reports within one business day of the time of the request.
  5. The inventory management staff maintains the templates for inventory information from the e-commerce retailer customers within a file folder on a hard drive on the PC computer system in the Inventory Management office. Recall from the Background Information section that e-commerce retailers will generally require that their company-specific templates be used when transmitting inventory-related information such as complete product descriptions. Once the templates are populated with the requested information, the Inventory Management staff can transmit that information to the e-commerce retailers by logging in through the retailer’s extranet portal for MDU.

The Tasks:

Obviously, you will be facing a challenge in effectively determining systems requirements for this project. Based on the information provided in Chapter 6 of the course textbook and web-based research, your team’s task here is to select an overall strategy for determining system requirements. In addition, you have decided to develop an interview process with various employees of the company to assist in determining the information requirements needed to support the development of a system that meets the scope of the planned system. Your deliverable for this component of the team project is to include the following components:
